Charges withdrawn in police chase

Charges were dropped Wednesday against a Tamaqua man accused of fleeing police in Palmerton, but he still remains in jail.

That's because he's still facing charges in Lehigh County and new charges that were filed against him in Lansford.Kenneth Charles Conklin Jr., 41, remains in Lehigh County Prison under $75,000 cash bail.He was brought from Lehigh prison to Palmerton on Wednesday for a hearing before District Judge William J. Kissner on charges of flight to avoid apprehension, driver's license suspension, careless driving and reckless driving.Assistant District Attorney Brian Gazo said police were forced to withdraw the charges against him because the key witness in the case didn't show.He said the charges likely will be refiled.On Wednesday afternoon, Lansford police filed charges against Conklin in the office of District Judge Casimir Kosciolek. The charges, filed by officer Joshua P. Tom, accuse Conklin of being a habitual offender, driving while his license was suspended or revoked and driving without a license. The charges stem from Oct. 3, 2015.Kosciolek set a hearing date of Feb. 17.In Lehigh County, Conklin faces 15 different counts. The charges were filed by state police at Fogelsville barracks as a result of incidents on Dec. 9 in Upper Macungie Township.He is charged with endangering the welfare of children, carrying a firearm without a license, fleeing police officers, possession of a controlled substance, possession of drug paraphernalia.Also corruption of minors, recklessly endangering another person, driving while intoxicated on a suspended license, failure to stop at a red signal, disregard of traffic lane, depositing waste on the highway, careless driving, reckless driving, failure to use safety belt for the driver and front seat occupant, and possession of a prohibited firearm.He waived these charges to Lehigh County Court on Jan. 7 after appearing before District Judge Michael J. Faulkner in Allentown.The Palmerton charges stem from an incident at 1:26 a.m. Dec. 5 in Palmerton, two days after the Lansford incident and four days before the Upper Macungie arrest.Officer Dane O'Brien of the Palmerton Police Department is the arresting officer.The affidavit says that on Dec. 5, O'Brien saw a red sedan merge from Third Street onto Delaware Avenue, traveling in the direction of Route 248 "in an overcompensated manner." O'Brien wrote, "I observed the vehicle swerve in a continuous manner within its lane of travel."O'Brien began following the vehicle, which he said, "abruptly accelerated and turned onto Second Street."The police officer said the driver abandoned the vehicle and fled on foot in an unknown direction.That same day, at 8:53 p.m., O'Brien was met at the Palmerton Police Station by Conklin's sister, Tanya, who told him that her vehicle was held by a towing company and wouldn't be released.Tanya Conklin said her brother had borrowed the vehicle the previous evening.She told police that Kevin "had informed her that he 'outran' the police after being spotted coming home from a friend's residence in Palmerton."O'Brien said in the affidavit he learned that Kevin Conklin "has several arrest warrants from surrounding agencies."
