Township to take legal action against home

A Franklin Township home is on the verge of being demolished.

The township’s board of supervisors last week agreed to proceed with litigation in the Carbon County Court of Pleas against Theresa Berger.

According to the lawsuit, Berger owns the property at 1345 Main Road that is the subject of the complaint.

The township claims that the property — a single family residence — has fallen into disrepair and is currently collapsing in on itself.

On June 16, 2016, Carl Faust, building code enforcement officer, sent a letter to Berger informing her that her property was in violation of the building code.

The lawsuit claims that Berger has taken no steps to remediate or resolve the violation.

It also states that Berger is in violation of the township’s property maintenance code in that it has been allowed to “enter a state of dilapidation, deterioration and decay.”

The lawsuit claims that Berger’s property “is in a dangerous condition in that it will likely collapse, and therefore has the potential to injure people and damage others’ property.”
