Carbon County court - DUI
Six defendants who previously pleaded guilty to driving under the influence charges were sentenced on Tuesday in Carbon County court.
Judge Joseph J. Matika imposed sentences on the following:Gervase J. Purcell III, 55, of Blakeslee, was sentenced to serve five days to six months in prison, pay a fine of $300, license suspended for a year, zero tolerance for drug and alcohol use, and render 25 hours of community service.He was arrested on Dec. 24, 2015, along Moseywood Road by Kidder Township police. A test revealed a 0.21 BAC.Before the start of the sentencing proceeding, Purcell admitted to a probation violation and was sentenced to serve 30 to 60 days in prison, concurrent with the DUI term. However, he must serve the full 60 days and was granted work release privileges.He will begin the jail term at 8 a.m. May 26.Shannon Lee Fisher,35, of Kunkletown, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service.She was arrested on July 26, 2015, along Hudson Street in Packer Township by state police at Hazleton. A test showed the presence of a controlled substance. She will begin the jail term at 8 a.m. May 24.Derrick Michael Boyland, 35, of Albrightsville, was sentenced to serve five days to six months in jail, a fine of $300, one-year license suspension, zero tolerance for drug and alcohol use and render 25 hours of community service.He was arrested on Dec. 5, 2015, along Route 1003 by Kidder Township police. A test revealed a 0.23 BAC.He will begin the jail term at 4 p.m. May 28 and serve two days and then on June 2 and serve three days.Crystal S. Loar,52, of Lehighton, was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.She was arrested on Feb. 7, 2015, along Blakeslee Boulevard Drive East by Mahoning Township police. A test showed 0.18 BAC.Jude Makowiec,28, of Mahanoy City, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service.He was arrested on Dec. 6, 2014, along Broad Street by Beaver Meadows police. A test showed the presence of a controlled substance.He will begin the jail term at 5 p.m. May 24.Rose Marie Miller,34, of Jim Thorpe, was sentenced to serve six months in the county's Intermediate Punishment Program with the first 20 days on electronic monitoring. She was also ordered to pay a fine of $300, one-year license suspension, zero tolerance for drug and alcohol use and render 25 hours of community service.She was arrested on Dec. 17, 2015, along Route 903 by Kidder Township police. A test showed 0.23 BAC.Each defendant must also pay court costs of about $1,000, pay a $50 per month supervision fee while on probation or parole and follow all recommendations of their drug and alcohol evaluation.
