Jurors find Shawn Christy guilty of assault

Before U.S. Marshals went on a multistate manhunt for him last summer, Shawn Christy was set to face trial on assault charges from a fight which took place in 2017 in McAdoo, Schuylkill County.

On Monday, that trial finally took place.

Jurors found Christy guilty of simple assault but not guilty on a more serious charge of aggravated assault. The charges stemmed from a fight with former McAdoo Mayor Stephan Holly, caught on tape outside McAdoo borough hall following a snowstorm in March 2017.

The prosecutor in the case said he was pleased with the verdict.

“We’re happy that the jurors took the time and thought to consider all the facts in delivering their verdict,” said Jordan Fegley of the Berks County District Attorney’s office.

Christy’s father, Craig, said they were pleased that the jury found Christy not guilty on the most serious charges, but felt he should have been exonerated completely.

“We beat a lot of it down. I still don’t believe it’s a just decision,” he said.

Christy served as his own attorney and took the stand in his defense during a trial which started and ended on Monday in Schuylkill County Court.

The Berks County District Attorney’s office was called in to prosecute the case.

Schuylkill County District Attorney Michael O’Pake recused his office from the case because he served as Christy’s public defender in the past.

Christy admitted that on March 15, 2017, he swung a 4-foot walking stick at Holly during an argument about snow removal in an act of self-defense.

He said he was trying to block Holly from punching him while Holly got out of his truck in the parking lot of McAdoo Borough hall.

Christy argued that the two men fought after a heated conversation, and he was left with a split lip and neck pain.

Holly testified that he got out of his truck because he felt that Christy was going to try to attack him or one of the borough employees. He said that when Christy approached the vehicle he had a “nasty look in his eyes, an evil look.”

Jurors watched surveillance footage, which showed Holly getting out of the truck, Christy swinging the stick, and an ensuing melee where the two men fought in the snow.

During deliberations they asked to watch the video again.

After about three hours they returned a verdict of not guilty on charges of aggravated assault, but guilty on one of three counts of simple assault.

Dolbin also found Christy guilty of a summary offense of harassment.

During the trial, Judge Cyrus Dolbin dismissed three of the counts against Christy. He said those charges only applied in cases where a law enforcement officer was being attacked, and didn’t apply to Holly at the time.

Craig Christy said following the verdict that both parties in the fight should have been charged.

“The problem was he has never been a police officer. Holding Shawn on the ground until the police came is illegal. That’s what really got us upset,” he said.

Jury selection was set to get underway last summer right around the time that U.S. Marshals began a multistate manhunt for Christy.

Christy has been accused of stealing multiple vehicles, breaking into multiple homes and businesses, and making threats against elected officials while he was a fugitive.

A federal trial is set to get underway Nov. 12 in Scranton in that case.
