Drunk driving cases dominate court session
Driving under the influence (DUI) cases dominated a Carbon County court plea session on Thursday. Judge David W. Addy presided and accepted pleas from the following defendants.
Timothy Porter Amidon, 47, of Andreas, pleaded to one count of DUI. He was arrested on July 1 along E. Lizard Creek Road, in East Penn Township. Given a test, the result was .16BAC.Addy sentenced him to serve 30 days to six months in jail, a fine of $750, one year license suspension and get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment.Amidon will serve two days in prison and 28 in the county's Intermediate Punishment Program (IPP) with electronic monitoring. He will began the jail term on Friday, Oct. 23, at 9 a.m.Dylan Richard Bertuola, 21, of McAdoo, pleaded to one count of DUI. He was arrested on Nov. 17, 2007, along SR309 in Banks Township. Given a test, the result was .07BAC.Addy sentenced him to serve 48 hours to six months in jail, a fine of $500, one year license suspension and ordered to get a D&A evaluation.He will began the jail term at 9 a.m. on Oct. 24.Sueanne M. Giarretta, 58, of Richlandtown, Bucks County, pleaded to one count of possession of a controlled substance. She was arrested on May 29 by agents of the state Attorney General's office.Addy placed her on probation for six months and ordered she continue her current drug treatment program.Timothy John Goszka, 25, of Pen Argyl, pleaded to one count of DUI. He was arrested on June 5 along SR2015, in Franklin Township. Given a test, the result was .12BAC.Addy sentenced him to serve 30 days to six months in jail, a fine of $750, one year license suspension, and get a D&A evaluation. On a stop sign violation he weas fined $25 and costs.Brett Anthony Montanari, 20, of Lehighton, pleaded to one count of receiving stolen property. He was arrested by Palmerton police for an incident on May 31, 2008, in which Thomas Smith was the victim.Addy placed him on probation for six months, ordered he make restitution of $172.72 and render 10 hours of community service.Michael Paul Wallace, 26, of Palmerton, pleaded to one count each of presistent disorderly conduct and public drunkenness. He was arrested on Sept. 12 by Palmerton police for an incident at the Palmerton hospital.Addy sentenced him to time served (40 days) to one year in jail, on the disorderly conduct charge and ordered him to get a D&A evaluation and zero tolerance on D&A use. On the drunkenness charge he was fined $100 and costs.Maura T. Ward, 46, of White Haven, pleaded to one count of DUI. She was arrested on May 31 along W. Main St., in Weatherly. Given a test, the result was .28BAC.Addy sentenced her to serve five days to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation and zero tolerance on D&A use. She will serve the jail term on consecutive weekends of three and two days beginning Oct. 27 at 9 a.m.John E. Wilcott, 27, of Lehighton, pleaded to one count of DUI. He was arrested on May 22 along Broad St., in Beaver Meadows. A test revealed marijuana in his system.Addy sentenced him to serve 72 hours to six months in jail, a fine of $1,000, one year license suspension, get a D&A evaluation and zero tolerance on D&A use. He began the jail term on Oct. 23 at 9 a.m.All defendants must pay court costs and a $50 per month supervision fee.
