Luzerne man given prison term for theft incident
A Hazleton man was given a Carbon County prison term on Tuesday after entering a guilty plea before Judge David W. Addy. He was one of several defendants to enter a plea before Addy.
Banks incidentRichard K. Asay, 43, of Hazleton, pleaded to one count of receving stolen property. Asay was arrested by state police at Hazleton for removing property from Fimbel Door Co. in Banks Township on April 28.Addy sentenced him to serve three to 12 months in prison and ordered he make restitution of $1,185 and pay at least $150 a month on the restitution. He will begin the jail term on Sept. 21 at 9 a.m. and was granted work release privileges.Other pleasOther defendants who entered pleas before Addy included:Mark Christian Binder, 22, of Fredericksburg, Va., pleaded in two cases. He pleaded to one count of criminal conspiarcy-theft for an incident on Nov. 1, 2008, in which a vehicle was stolen in Whitehall and recovered in Carbon County. In the second case he pleaded to one count each of forgery and theft for an incident on the same day involving a credit card.Addy placed him on probation on each count, running consecutively, and ordered he make restitution totaling $202 with zero tolerance on drug or alcohol use.John S. Bizarre Jr., 46, of Weatherly, pleaded to one count each of driving under the influence (DUI) and driving under suspension-DUI related. He was arrested on Nov. 9, 2008, along Broad St., in Beaver Meadows. Given a test, the result was .22BAC.On the DUI count he was sentenced to serve 10 days to two years in prison, a fine of $500 and one year license suspension. On the driving under suspenson charge he was sentenced to serve 90 days in jail, a fine of $1,000 and another year suspension. He must also get a drug and alcohol evaluation and follow any recommendation for treatment, and zero tolerance on drug or alcohol use. The prison terms run concurrently. He will begin the jail term on Sept. 14 at 9 a.m. and was granted work release privileges.Edgar A. Gonzalez, 51, of Hazleton, pleaded to one count of receiving stolen property. He was arrested April 28 by state police at Hazleton for an incident in Banks Township. This is a companion case to Asay.Addy placed him on probation for six months. His restitution share in the case has already been paid.Curtis D. Huffman, 45, of Lehighton, pleaded to one count of simple assault. He was arrested on July 30, 2008, for an incident in East Penn Township in which Larry Eck Jr. is the listed victim.Addy placed him on probaiton for a year and ordered he continue his drug and alcohol treatment program. He was given credit for seven days against the sentence.Christopher Brian White, 23, of Weatherly, pleaded to one count of possession with intent to deliver a controlled substance-marijuana. He was arrested on April 26 in the area of Church St., in Beaver Meadows.Addy placed him on probation for three years and ordered he get a D&A evaluation, zero tolerance on drug or alcohol use, suppy a DNA sample and pay the $250 fee, and obtain and maintain full time employment.Each defendant must also pay court costs and a $50 per month supervision fee.
