Six first-time offenders placed in ARD program
Six first time offenders in the criminal justice system were placed in Carbon County's Accelerated Rehabilitation Disposition (ARD) probation program on Tuesday.
If a person successfully completes all conditions of the program their record his wiped clean. However, if they fail to complete the program, or are revoked from it, they will face trial on all pending charges. Person does not admit guilt in entering the program.President Judge Roger N. The six were placed on driving under the influence (DUI) charges..Paul Edward Fayocavitz, 38, of Albrightsville, was arrested on Feb. 5 by state police at Fern Ridge along Old Stage Rd, in Penn Forrest Township. Given a test, the result was .13 BAC.He was assessed $500 for the cost of the program, and ordered to get a drug and alcohol (D&A) evaluation and follow any recommendation for treatment, and license suspended for 60 days.James Lacey, 43, of Lansford, was arrested on June 19, 2012, on Flagstaff Road by Jim Thorpe police after being involved in an accident. Given a test, the result was .11BAC.He was assessed $500, and ordered to get a D&A evaluation, a mental health evaluation, and license suspended for 60 days.Dayton Nicholas Passehl, 23, of Lehighton, was arrested on Nov. 9, 2012, along Jefferson St., by Franklin Township police, after being involved in an accident. Given a test, the result was .22BAC.He was assessed $550, and ordered to get a D&A evaluation, license suspended for 60 days, and make restitution for damages to be determined by the adult probation office.Pablo Alberto Sosa, 21, of Weissport, was arrested on Jan. 20 along Bankway by Lehighton police. Given a test, the result was .08BAC.He was assessed $450, and ordered to get a D&A evaluation.Shannon Peter Steigerwalt, 38, of Lehighton, was arrested on Jan. 26 along Iron St., by Lehighton police. Given a test, the result was .17BAC.He was assessed $550, and ordered to get a D&A evaluation, and license suspended for 60 days.Mizaell Yarro, 23, of Lansford, was arrested on Dec. 29, 2012, along First St., by Lehighton police. Given a test, the result was .13BAC.He was assessed $500, and ordered to get a D&A evaluation, and license suspended for 30 days.Each defendant must also pay court costs, which average close to $1,000, and pay a $50 per month supervision fee while in the program.
