Carbon County court – ARD

Seven defendants in pending criminal cases were placed in Carbon County’s Accelerated Rehabilitation Disposition probation program by Judge Steven R. Serfass this week.

People who successfully complete all conditions of the program have their record wiped clean. However, if they fail to complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.

All were placed for a year, unless otherwise noted.

Regina M. Bergeron

, 58, of Tiverton, Rhode Island, was placed on a charge of possession of a small amount of marijuana.

Her husband, Thomas E. Bergeron, 57, was placed on a driving under the influence charge. Both were arrested following a traffic stop on May 28 by state police at Lehighton along Interchange Road in Towamensing Township. A test revealed Thomas Bergeron had a controlled substance in his system. A consent search by troopers found Regina Bergeron with marijuana.

Regina Bergeron was ordered to pay a $450 assessment fee for the cost of the program, get a drug and alcohol evaluation and follow any recommendation for treatment and render 50 hours of community service.

Thomas Bergeron was assessed $600 and ordered to render 50 hours of community service and his license was suspended for 60 days.

Stephen A. Howard

, 21, of Whitehall, was placed on a charge of resisting arrest. He was arrested on Aug. 28, 2018, in the area of 135 Lafayette Ave., by Palmerton police.

He was assessed $450 and ordered to get a mental health evaluation and render 50 hours of community service.

Barbara Lukasevich

, 65, of Jim Thorpe, was placed on a charge of obstruction of the administration of law enforcement. She was arrested on July 26 by Jim Thorpe police at a crash scene for causing a disturbance. She was not involved in the crash.

She was assessed $450 and ordered to render 50 hours of community service.

John Joseph Paul

, 34, of Lehighton, was placed on a bad check charge. He was charged by Lehighton police with issuing a bad check to the Lehighton Power & Light.

He was assessed $450 and ordered to render 50 hours of community service and make restitution to the borough of Lehighton for $1,167.77.

Karen Louise McIntosh-Ackerman

, 52, of Palmerton, was placed for six months on a DUI charge. She was arrested on Nov. 12, 2017, by Lehighton police along East Street. She refused a test.

She was assessed $650 and ordered to render 25 hours of community service and her license was suspended for 60 days.

Quinn Isaiah Temple

, 18, of Albrightsville, was placed for two years on a charge of simple assault and related counts. He was arrested on May 12, by state police at Fern Ridge for an incident along Van Doren Mews in Penn Forest Township with his brother, Samuel Johnson, the victim.

He was assessed $650 and ordered to get both drug and alcohol and mental health evaluations, render 100 hours of community service, make total restitution of medical bills of $1,190.23 and have no contact with the victim.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee and those charged with DUI, follow any recommendation of their drug and alcohol evaluation.
