POTTSTOWN (AP) — An eastern Pennsylvania man has been ordered to stand trial in the shooting death of a woman who was seeking a paternity test and child support from him.
Thirty-six-year-old Bobbie Mitchell Jr. was ordered to stand trial Monday in the April death of 23-year-old Siani Overby in Pottstown.
Authorities in Montgomery County say officers responding to reports of a woman screaming and shots fired found the victim dead on a sidewalk.
Prosecutors say Mitchell’s cellphone found next to the victim had text messages between Mitchell and Overby sent less than an hour before her death.
Defense attorney Charles Auspitz argued unsuccessfully that prosecutors hadn’t provided direct evidence linking his client to the killing.
Prosecutors must reveal by Mitchell’s Aug. 15 formal arraignment whether they plan to seek the death penalty.
