A Lehighton woman who admitted selling heroin was sentenced to a state prison term this week in Carbon County court.
Karen Marie Foster, 52, was sentenced to serve two to four years in a state correctional institution. She previously pleaded to one count each of possession with intent to deliver a controlled substance-heroin, and criminal use of a communication facility, both felonies.Judge Steven R. Serfass rejected a request from court-appointed defense counsel attorney Adam Weaver and Foster to place her in the county jail by imposing a sentence in the mitigated range.Serfass said, "I see no reason for mitigation, considering the facts of this case." He added, "I read the(presentence investigation report prepared by the adult probation office), and feel the recommendation is appropriate."Foster was arrested after she sold heroin to a confidential informant working for the Mahoning Township police.On May 3 the CI called Foster to set up a purchase at her residence in the 100 block ofJamestown Street. The CI went to the home and made the purchase. Police then secured a search warrant for the home.Heroin and other drug items were found inside the home.Foster told Serfass, "I'm not a drug dealer. A friend came to me and asked me to help him out." She added, "I realize what I did was wrong."Serfass also questioned a request from Weaver to let his client begin her jail term on Nov. 2. After some discussion, Serfass agreed to let her report to the county prison at 9 a.m. Friday.Serfass imposed the two- to four-year term on the possession with intent count and one to two years on the second charge, with the terms running concurrently. She was also ordered to get both drug and alcohol and mental health evaluations, zero tolerance for drug and alcohol use and supply a DNA sample. She was given credit for eight days spent in jail on the charges.
