Nursing home employee facing charges after taking videos of patients

A 28-year-old Freeland woman is facing multiple charges relating to abuse of a care dependent person while she was employed as a CNA at the Forest Hills Rehabilitation and Healthcare Center, Weatherly.

Omenny Arias was arraigned before Magisterial District Judge Beth A. Dodson of Lansford and initially committed to the Carbon County Correctional Facility, Nesquehoning, in lieu of $20,000 bail, before her bail was posted.

She is charged with violations of the Wiretapping and Electronic Surveillance Control Act that includes criminal use of communications facility and numerous violations of the abuse of a care dependent person.

In an affidavit of probable cause, Trooper Daniel Spath of Troop N, Hazleton, the arresting officer, said he was aware of Arias from a prior arrest of her paramour, Anthony J. Vega, who was taken into custody in April 2023 following his federal indictment by a grand jury of the Middle District of Pennsylvania on narcotics trafficking charges.

Spath said Arias was present when Vega was taken into custody at his residence at 9 Scotch Hills Drive, Drifton. The trooper indicated Vega is being held in the Pike County Correctional Facility.

Police obtained records of video calls made by Arias to Vega while she was employed at Forest Hill.

The officer said that on Jan. 28 he obtained records of a video call between Arias and Vega that took place around 5 p.m. Dec. 18, 2024. During the call, Arias clearly shows Vega the nursing home setting, and showed him a conversation with a male patient that rose to lewd, lasvicious or obscene language.

The affidavit states the video shows Arias and the patient discussing body parts and “making babies”; it shows the woman slapping his belly after he lifted his shirt; and involves Vega to the extent that he questioned her about sexual acts.

Spath said in his affidavit a second video call between Arias and Vega took place 7:42 p.m. Jan. 24 while the woman was at work.

The call records show Arias showing Vega a number of patients, including a female and three men, one of which she showed Vega “part of the patient’s body,” the affidavit states.

In all, Arias faces 11 different counts that include intercept communications, criminal use of a communication facility, abuse of a care dependent person, and striking, shoving or kicking attempts/threatening the care of dependent person.

She is awaiting a preliminary hearing scheduled to be held before Magisterial District Judge Joseph D. Homanko Sr. of Weatherly.
