Lehigh woman faces 5-20 years in son’s drug death

An Allentown woman, who in part was responsible for the death of her 22-month-old boy in 2021, accepted a plea bargain in Lehigh County Court on Thursday and faces up to 5 to 20 years in prison.

Jayleen Rivas-Rodriguez, 35, pleaded guilty to charges of involuntary manslaughter and endangering the welfare of a child, before Judge Anna-Kristie M. Marks. Authorities withdrew a previous third degree murder charge the woman was facing.

Rivas-Rodriguez is scheduled to be sentenced at 9:30 a.m. on Jan. 24.

On April 5, 2021, Allentown police were called to St. Luke’s Hospital for a report of a toddler who was not breathing. Johansy Suarez-Riva, was pronounced deceased at the hospital a short time later. Authorities said Johansy died from fentanyl toxicity.

The toddler was the son of Rivas-Rodriguez and Jorge Suarez-Santiago, 32, of Milwaukee, Wisconsin. The father is charged with murder of the third degree and is scheduled for a preliminary hearing at 10:45 a.m. on Dec. 13.

Officials said the two had used heroin in the hours before their son was declared dead. They said Rivas-Rodriguez left their son in the care of Suarez-Santiago knowing he was intoxicated. Rivas-Rodriguez also gave him with heroin.

The investigation revealed the toddler ingested a lethal dose of fentanyl while in the care of his parents
