Man charged with waving ‘Scream’ mask at neighbors
The father of a man charged with homicide in Lehighton in March has been charged with harassing his neighbors by waving a “Scream” movie mask similar to the one worn by his son in the killing.
According to the affidavit of probable cause filed by Cpl. Bruce Broyles of the Lehighton Borough Police Department in the case against Francis L. Moyer II:
Broyles was informed that Moyer, 68, of Lehighton, who was recently released from the Carbon County Correctional Facility was standing in his doorway staring at the caller, which was making her feel uncomfortable.
Broyles spoke with the caller, who advised she noticed Moyer, who lives in the 200 block of Carbon Street, staring at her for a lengthy period of time, and that she was a witness to the homicide which recently occurred by Moyer’s son.
The woman said Moyer was lodged in jail for harassing neighbors after his son’s homicide.
Moyer was recently released and there was a bail stipulation that Moyer was to have no contact with her, because she was a witness.
The woman said Moyer was standing in his doorway for such a long period of time, she got her phone to record the unusual behavior. As a result, Moyer began using his phone to record her.
She told police since Moyer was released from jail he has been harassing all neighbors by walking past their homes nonstop.
Broyles was able to speak with the Assistant District Attorney regarding this incident, and it was agreed that Moyer simply standing in the door of his own home staring at the victim was not an offense or a violation of bail.
However, the woman said Moyer placed a “Scream Mask” in the window of his home and began waiving it toward her. This was the same type of mask police said Moyer’s son used during the homicide.
On March 25, Moyer’s son, Zak, was charged with striking Edward Whitehead Jr., 59, who lived at 239 Carbon St., with a chain saw and a knife. He died from his injuries at St. Luke’s - Carbon campus.
Police said Zak Russell Moyer, 30, was wearing a mask and a black garment similar to the “Scream” movie character, is charged with the homicide.
Zak Moyer was seen on surveillance video footage exiting the rear of 239 Carbon St., and was seen entering the rear property at 241/243 Carbon St.
The information about the elder Moyer was relayed to the Assistant District Attorney, who told Broyles this is intimidation of a witness, and he should arrest Moyer.
Moyer was taken into custody without incident.
Broyles asked Moyer why he was staring at the neighbor and waiving objects at her through the window. Moyer denied doing such initially, but did eventually tell him that he was only looking through his window outside. He denied waiving anything through the window.
Broyles searched the house and located the “Scream Mask” in the dining room area of the home, about 10 to 15 steps from the front door.
The woman had video footage showing Moyer standing in his doorway staring at the victim, as well as footage of him in the window the mask was observed in by the victim.
Moyer faces a charge of intimidation of witness.
Moyer is currently incarcerated in the Carbon County Correctional Facility in lieu of $250,000 straight bail, and is scheduled to have a preliminary hearing May 29 before District Judge Eric M. Schrantz of Jim Thorpe.
