Schuylkill County Criminal Court

Schuylkill County judges have ruled on the following cases.

Christina Tumminello, 41, of Coaldale, was charged by West Penn Police Chief James E. Bonner with possession of a controlled substance and possession of drug paraphernalia on Sept. 15, 2022.

Judge Christopher Hobbs sentenced her to serve 12 months on probation on the paraphernalia charge. The controlled substance charge was dropped.

Patricia Boyke, no age given, of McAdoo, was charged by Kline Township Police Officer Paul D. Bowman with two counts of failing to keep a dangerous dog confined within the premises of the owner and harboring a dangerous dog that killed/injured domestic animal on Sept. 3, 2022.

Senior Judge D. Michael Stine granted a summary appeal; Boyke must pay a total of $1,100 in fines.

Jeffrey D. Sell Jr., 46, of Orefield, Lehigh County, was charged by West Penn Township Police Officer John C. Kaczmarczyk with operating a vehicle without insurance on Oct. 2, 2022.

Senior Judge Stine granted a summary appeal, dropping the charge.

Ricky David Boyer, 64, of New Ringgold, was charged by West Penn Police Chief James E. Bonner with careless driving on Sept. 2, 2022.

Judge Stine issued a summary appeal, and found Boyer not guilty.

Samantha Lynn Kuntz, 34, of Lehighton, was charged by Rush Township Police Officer Robert A. Bechtel with retail theft and receiving stolen property on March 10, 2022.

Judge Christina E. Hale sentenced her to serve one to 23 months in jail and to undergo a drug and alcohol evaluation on the retail theft charge.

On the receiving charge, Kuntz was sentenced to 12 months on probation, to be served at the same time as the theft charge. She was also ordered to pay court costs.

Joshua Fry, 41, of Tamaqua, was charged by Coaldale Police Officer Christopher J. Cordes with possession of a controlled substance and possession of drug paraphernalia on May 28, 2022.

Fry pleaded guilty to the paraphernalia charge, and Judge Charles M. Miller sentenced him to time served to 12 months in jail.

After having already served a total of 50 days, Fry was immediately released.

Miller also ordered him to pay $100 in fees.

The controlled substance charge was dropped.

Lance Allen Moser, 33, of Lehighton, was charged by Frackville State Trooper Todd W. Heintz with burglary; criminal trespass - entering a structure; criminal mischief; and criminal trespass/simple trespasser, on Feb. 25, 2020.

Judge Christopher Hobbs dropped all charges against Moser.

Lindsey Spachman, 23, of Mt. Carmel, was charged by Rush Township Police officer Richard A. Weaver with theft of leased property on June 25, 2022.

Judge Hobbs accepted her guilty plea, and sentenced Spachman to $753.60 restitution to Rent-A-Center; pay court costs; pay a $50 a month supervision fee; submit a DNA sample and pay the $250 fee; and serve 18 months on probation.

Howard Ash, 44, of Lansford, was charged by Coaldale Police Officer Matthew O. Jungbaer with disorderly conduct on Nov. 23, 2022.

Senior Judge Stine granted a summary appeal, ordering Ash to pay a total of $109 in court costs and fees.

Jason M. Dietrich, 41, no address given, was charged by Coaldale Police Officer Matthew O. Jungbaer with two counts of possession of a controlled substance and one count of possession of drug paraphernalia on Feb. 18, 2021.

Judge Hobbs accepted his guilty plea, and sentenced him to serve six to 23 months in jail, to be served at the same time as a Carbon County sentence; pay court costs; and pay a $50 a month supervision fee.

On the second count, Hobbs sentenced Dietrich to serve the same sentence as the first charge, concurrently.

On the paraphernalia charge, Hobbs sentenced him to serve one year on probation.

Matthew Scott Creveling, 34, of Lansford, was charged by Frackville State Trooper Thomas Powell with retail theft on Nov. 9, 2021.

Judge Hobbs accepted his guilty plea, and sentenced him to serve 9 to 23 months in jail; served at the same time as two Carbon County sentences; pay a total of $150 in fees; pay a $50 a month supervision fee; and to submit a DNA sample and pay the $250 fee.

James Carroll III, 46, of Summit Hill, was charged by McAdoo Police Officer William M. Curilla, Jr. with driving under the influence of a controlled substance, first offense; driving under the influence of a Schedule 1 controlled substance, first offense; driving under the influence of a controlled substance, metabolite, first offense; possession of a small amount of marijuana for personal use; possession of drug paraphernalia; not having rear lights; improper sunscreening; and driving without a license on July 7, 2018.

Judge Hobbs accepted his guilty plea to the first DUI charge, and sentenced him to serve 72 hours to six months in jail, with immediate parole; pay a $1,000 fine; pay court costs; pay $332.15 and $414.72 restitution to the District Attorney’s Office for bench warrant fees, and $400 to Lehigh Valley Health Network; pay an additional $175 in fees; pay a $50 a month supervision fee; successfully complete Alcohol Highway Safety School; perform 10 hours of community service; attend outpatient drug and alcohol treatment for two to three months; have his license suspended for 12 months.

The remaining charges were dropped.

Thomas J. Burns, 54, of Coaldale, was charged by Coaldale Police Officer Brandon L. Gonzalez with harassment on Aug. 7, 2022.

Judge Hobbs accepted his guilty plea, and sentenced him to serve 12 months on probation; pay court costs; pay a $50 a month supervision fee.

Ashley Bynon, 29, of Tamaqua, was charged by Frackville State Trooper Todd W. Heintz with retail theft on Oct. 20, 2022.

Judge Hobbs accepted her guilty plea and sentenced her to serve 12 months on probation; pay court costs; pay a $50 a month supervision fee; pay $150 in fees; and to submit a DNA sample and pay the $250 fee.
