Suit over fire

Daphne C. Gasker, 46 Coal St., Jim Thorpe, has filed a civil suit seeking damages against her neighbor, Evan M. Levitz, 44 Coal St., over a fire that started in the defendant’s home and spread to the plaintiffs’ property.

The suit alleges negligence against the defendant for the fire, which occurred on Dec. 1, 2022.

Among the allegations made in the suit is that the defendant allowed trash, newspapers, magazines, junk mail, clothing and personal possessions to accumulate in his home allowing the home to be “packed with highly flammable combustible materials.”

It is further alleged that the defendant used numerous space heaters to heat the home while failing to have his electrical system inspected to determine if the load from numerous space heaters could be safely supported by the existing electrical system.

Sought are damages for fire, smoke and water of $17,000 and additional damages for fire, smoke and water for $150,000.
