Lehighton man given jail term in simple assault case

A Lehighton man was sentenced in Carbon County court to a county prison term last week in an assault case.

Russell L. Frankenfield, 54, was sentenced by Judge Steven R. Serfass to serve one to one day less 24 months in prison for simple assault. In exchange for the plea, another count of simple assault and charges of recklessly endangering and terroristic threats were dropped.

It was the same sentence imposed in 2021 by Serfass.

Frankenfield was sentenced over a dispute that occurred on March 17, 2018, in Franklin Township. Frankenfield was charged for assaulting a woman.

He previously entered a plea in case and was sentenced by Serfass to the same term. After the sentence was imposed Frankenfield said he wanted to withdraw his plea.

Court records show that he filed a post-sentence motion asking the court for reconsideration of the sentence imposed. Serfass denied the motion.

Frankenfield then filed a petition with the state Superior Court for reconsideration. That court issued an order sending the matter back to the local court for resentencing.

Last week before imposing the jail term, Serfass said he had concerns about the facts of the case and the nature of what happened and for the woman.

Serfass also ordered Frankenfield to make restitution to the woman for $1,234.10, have no contact with the her, supply a DNA sample, pay court costs of over $1,000, render 100 hours of community service and was given credit for one day already served.

Serfass said Frankenfield will serve the remaining 29 days on consecutive weekends beginning at 6 p.m. on Jan. 6, 2023.
