Parole/probation revocation hearings held

Carbon County judges conducted parole/probation revocation hearings during February on petitions filed by the adult probation office.

The petitions were filed against defendants who violated their parole/probation terms. Those who had hearings included:Timothy Simcsuk, 26, of Palmerton, had his probation revoked on a charge of driving under the influence (DUI) on a petition filed by probation officer Kimberly Cooper for violating the terms by failing to report to the probation office as required, not residing at approved residence, failed to get drug and alcohol treatment, and community service work not reported.Judge Joseph J. Matika resentenced Simcsuk to serve two to four months in the county prison effective Dec. 14, 2013.Simcsuk has also been charged with interference with custody of children after abducting his 4-year-old daughter from her guardian's house Dec. 14. The case sparked a statewide Amber Alert until the child was safely located and Simcsuk was arrested.Matthew Frederick, 20, of Palmerton, had his parole revoked on charges of aggravated assault, theft, and criminal trespass, on petition of Cooper for violating the terms by being cited by Palmerton police for disorderly conduct, testing positive for marijuana, which violated the zero-tolerance provision of his release.Matika resentenced him to serve the maximum date of his sentence, which runs to March 15.Brian McGee, 31, of Palmerton, had his parole revoked on a charge of possession with intent to deliver a controlled substance on petition filed by Cooper for violating the terms by testing positive for marijuana, which violated the zero-tolerance provision.President Judge Robert N. Nanovic II resentenced him to serve 30 days in prison effective Feb. 4, followed by one year of probation.Daniel Snyder, 28, of New Ringgold, had his parole revoked on a charge of criminal mischief on petition filed by Cooper for violating the terms by failing to stay for an office appointment, failed to report to the probation office as scheduled, tested positive for amphetamines, which violated the zero-tolerance provision.Matika resentenced him to serve out his maximum sentence which ran to Feb. 15, and on a second case recommitted to the county prison to serve 222 days effective July 8, 2013.Jennifer Gongora, 28, of Kunkletown, had her probation revoked on a retail theft charge on petition filed by Cooper for violating the terms by admitting the use of heroin, admitted using Xanax and submitted an adulterated urine screen.Judge Steven R. Serfass resentenced Gongora to serve nine to 18 months in the county prison effective July 23, 2013.George Heffelfinger, 39, of Lansford, had his parole revoked on charges of simple assault and terroristic threats on petition filed by probation officer Clifford Eckhart for violating the terms by being charged with a new criminal offense-DUI, testing positive for marijuana, which violated the zero-tolerance provision.Serfass resentenced him to serve nine months "back time" in the county prison.Keith Evert, 24, of Coaldale, had his parole revoked on a DUI charge on petition filed by Eckhart for violating the terms by testing positive for a controlled substance, failing to obtain a drug and alcohol evaluation and follow the recommendations, and failing to perform 25 hours of community service.Nanovic resentenced him to serve 45 days back time in the county prison effective March 14, and it will run consecutive to a sentence previously imposed.Cody Silliman, 20, of Jim Thorpe, had his probation revoked on a charge of possession of a controlled substance on petition filed by probation officer Joseph Bettine, for violating the terms by failing to submit for two scheduled urine screens, which violated the zero-tolerance provision.Serfass resentenced him to serve four to eight months in the county prison effective June 2 at 9 a.m. However, if he completes 50 hours of community service and pays court costs totaling $1,299 in full by that date the order will be vacated.Kyle Brodt, 23, of Albrightsville, had his placement in the accelerated rehabilitation disposition (ARD) probation program revoked on petition filed by Bettine for violating the terms by failing to pay court costs.Serfass deferred the revocation to June 2. If Brodt pays in full his costs by that date the order will be vacated.Ashley Matz, 20, of Jim Thorpe, had her probation revoked on a charge of possession of a controlled substance on petition filed by Bettine for violating the terms by failing to report to the probation office as required and associating with Ryan Wurst, which she was prohibited from doing.Serfass resentenced her to serve six to 12 months in the county prison effective Nov. 13, 2013, followed by one year probation.Randall Perry, 23, of Jim Thorpe, had his probation revoked on a charge of receiving stolen property on petition filed by Bettine for violating the terms by being arrested by Jim Thorpe police for theft and receiving stolen property on two occasions: Oct. 28 and 30, 2013.Serfass resentenced him to serve six to 12 months in the county prison effective Nov. 14, 2013.Rodney Rider, 32, of Jim Thorpe, had his parole revoked on charges of DUI and possession of marijuana on petition filed by Bettine for violating the terms by being arrested by state police on April 8 for false identification to law enforcement, DUI, and summary offenses, by not making a concerted effort to pay court costs, failing to obtain a drug and alcohol evaluation, failing to attend alcohol treatment classes, and failing to complete 25 hours of community service.Serfass resentenced him to serve 150 days "street time."Carrie Reinhart, 36, of Avalon, N.J., had her parole revoked on a DUI charge on petition filed by Bettine for violating the terms by not making a concerted effort to pay court costs, failing to get a drug and alcohol evaluation and failing to complete alcohol treatment classes.Nanovic resentenced her to serve three months back time in the county prison effective June 2, at 9 a.m. However, if she gets her D&A evaluation and follows all recommendations, attends and completes D&A classes, and pays $650 on her court costs, plus makes her regular monthly payments by that date, the order will be vacated.Keith Evert, 24, of Coaldale, had his parole revoked on a charge of DUI on petition filed by Eckhart for violating the terms by testing positive for a controlled substance, failing to obtain a drug and alcohol evaluation and failing to perform 25 hours of community service.Serfass resentenced him to serve 45 days back time in the county prison effective March 14 at 7 p.m. and ruled it runs consecutive to any other sentence he is currently serving.Matthew Borst, 23, of Walnutport, had his parole revoked on a charge of possession of a controlled substance on petition filed by probation officer Joseph Berke, for violating the terms by failing to report to the probation office, relocating his residence without approval, being delinquent on his court costs, failing to obtain a drug and alcohol evaluation, and failing to report for a urine screen, which violates the zero-tolerance provision.Nanovic remanded to the county prison to serve three months back time effective Feb. 8.Ian Brader, 23, of Allentown, had his probation revoked on a charge of simple assault on petition filed by Berke for violating the terms by failing to report to the probation office, relocating his residence without permission, being delinquent on court costs, failing to obtain a drug and alcohol evaluation, failing to complete community service and failing to complete anger management.Serfass resentenced him to serve two to six months in the county prison effective Feb. 1.Jeanne Thorpe, 41, of Jim Thorpe, had her parole revoked on a charge of forgery on petition filed by Eckhart for violating the terms by being charged with retail theft, testing positive for a controlled substance, and unsuccessfully being discharged from drug and alcohol treatment.Serfass resentenced her to serve 80 days back time in the county prison. She received credit for 80 already served on the sentence and was paroled.Robin Hosier, 52, of Lansford, was revoked from the ARD program on a charge of DUI on petition filed by Eckhart for violating the terms by testing positive for a marijuana.Matika placed the case on the next pretrial list.Carl Mazur, 26, of Weatherly, had his parole revoked on a charge of fleeing or attempting to elude police on petition filed by Bettine for not completing 50 hours of community service.Matika resentenced him to serve three months back time effective June 2 at 9 a.m. However, if he completes the community service by that date, the order will be vacated.Michael Halvorsen, 34, of Summit Hill, had his parole revoked on a charge of persistent disorderly conduct on petition filed by Bettine for violating the terms by failing to obtain a drug and alcohol evaluation, failing to complete mental health treatment, and failing to complete 50 hours of community service.Matika resentenced him to serve three months back time effective June 2 at 9 a.m. However, if he completes the D&A evaluation, mental health treatment and 50 hours of community service by that date the order will be vacated.
