Albrightsville man gets jail term for resisting arrest, trespass counts
An Albrightsville man was sentenced to a Carbon County prison term on Thursday after previously pleading guilty to criminal counts.
Reinaldo Magobet, 46, was sentenced by Judge Steven R. Serfass to serve three to one day less 24 month in prison on a resisting arrest charge and 2 to 12 months on a persistent disorderly conduct charge. On a trespass count he was placed on probation for a year, consecutive to the other charges.
Magobet was originally charged with violating a protection from abuse order.
According to the affidavit of probable cause filed by patrolman Jim Thorpe office Ryan Poeldnurk: On Dec. 28, 2021, at 12:30 p.m. Poeldnurk and patrolman Corey Herring were dispatched to a home in the 200 block of South Street for a report of a woman being actively assaulted by Magobet.
Poeldnurk talked to the victim and a man who said Magobet broke into the home through a locked door in the basement and had just assaulted the victim and run to the rear of the residence.
The victim had a clump of hair in her hand that Magobet had pulled out and she also had several red marks on her neck. She said Magobet had choked her with his hand.
Officers saw Magobet inside his silver Jeep and asked him several times to get out of the vehicle, but he refused and attempted to hold down the locks on the doors when they attempted to unlock them.
Officers gained access and Magobet became irate and yelled obscenities.
Officers had to use physical force to place him into custody.
While inside the holding cell, Magobet continued to spit inside the cell.
Magobet is in violation of indirect criminal contempt in regard to the active PFA.
Magobet was also ordered to render a total of 200 hours of community service when paroled, get both a mental health and drug and alcohol evaluations, have no contact with the victim, pay court costs of over $1,000 and pay a $50 per month supervision fee while on parole or probation.
Magobet is currently an inmate in the county prison and was given credit for 76 days already served.
