Man charged after firing shot out window

A Summit Hill man faces multiple charges including attempted aggravated assault with a deadly weapon after firing a shot out his residence window, which came near a bystander working on a vehicle.

Michael Anthony Tessitore, 40, was arraigned Wednesday morning in front of Magisterial District Judge Joseph Homanko and placed in Carbon County Prison in lieu of $50,000 cash bail.

Summit Hill Police officer Kodie Pituch said he was on patrol in the 200 block of West White Street just after 6:30 p.m. Tuesday, when a man who had been working on a vehicle outside flagged him down.

The victim told police Tessitore leaned out of a window to the residence and asked him to identify himself, which he did. An argument ensued and Tessitore stated, “I’m going to shoot you,” to which the victim responded, “go ahead.”

Tessitore, according to the victim, then brandished a black, .22 caliber revolver and fired a shot near him. The victim fled the scene on his bicycle.

Pituch said he saw Tessitore in the first-floor window of the residence and held him at gunpoint, while giving him commands to come out onto the pavement.

Another officer arrived and after Tessitore refused to come out, the two pulled him out of the window and on to the ground.

“Once the defendant was on the ground, he failed to give us his hands and it took officers substantial force to overcome his resistance,” Pituch said.

After a short struggle, Tessitore was taken into custody without further issue. He declined to give police a written statement.

In addition to attempted aggravated assault, Tessitore faces one count each of prohibited possession of a firearm, terroristic threats, simple assault, resisting arrest, reckless endangerment and harassment.

A preliminary hearing is scheduled for 2:45 p.m. Aug. 11.
