Man, intoxicated, charged with causing disturbance at drive-in theater
A homeless man has been charged with resisting arrest after causing a disturbance at a drive-in theater on June 28.
According to the affidavit of probable cause filed by officer James Danner of the Mahoning Township Police Department:
At 2:31 p.m. Danner was dispatched to the Mahoning Drive-In Theater on Seneca Road for a disturbance.
The caller reported that an intoxicated man was initially refusing to leave the property and became irate when confronted.
The man eventually left the property in a maroon vehicle and reportedly parked down the road under the drive-in marquee.
At 3:46 p.m., officer Tyler Meek and Danner arrived on scene and saw John Kelly, 34.
Danner noticed that Kelly had slurred speech and was slow with verbal responses, so he explained to him that the property owners did not want him on the property and that he had to leave.
Kelly admitted to consuming alcohol and said that he was most likely over the limit and unable to drive. He was asked to submit to a test to see if he capable of safe driving. He agreed.
While Meek was retrieving the test, Kelly became belligerent and began yelling profanities.
Meek attempted to administer the test, but Kelly refused unless he was in control of his device, and threatened to flee in his vehicle.
Kelly again became belligerent and Meek removed the keys from the vehicle ignition.
After realizing that his keys were removed, Kelly became irate and began yelling at Meek.
Kelly resisted arrest, and was taken to the ground, at one point managing to grab a cuff in an effort to prevent it from being placed on his wrist.
After a brief struggle, Danner was able to handcuff Kelly.
Meek suffered an injury to the shoulder while attempting to place Kelly into custody.
Kelly faces charges of resisting arrest; disorderly conduct; criminal trespass; and public drunkenness.
He is currently incarcerated in the Carbon County Correctional Facility in lieu of $50,000 monetary bail, and is scheduled to have a preliminary hearing July 8 before District Judge Casimir T. Kosciolek of Lansford.
