Carbon County court - DUI

A Bangor man was given a year in jail for drunken driving on Monday in Carbon County court.

He was one of five defendants who previously pleaded to driving under the influence and were sentenced by President Judge Roger N. Nanovic.Prior convictionsBecause of prior convictions,Harry Clarance Read III, 37, was given a prison term of one to five years. He was arrested on Sept. 24, 2015, along Route 209 in Franklin Township by state police at Lehighton. A test showed the presence of a controlled substance.Read is currently serving a probation violation term which maxes this month.Nanovic also ordered Reed to pay a fine of $2,500, license suspended for 18 months and upon his release on parole must enter an inpatient, long-term rehabilitation program. He was given credit for 52 days on his sentence.Other casesKenneth Heckman Jr., 32, of Nesquehoning, was sentenced on two DUI cases. Before being sentenced he entered a guilty plea to a charge of retail theft.He was arrested on the theft count on June 21 by Mahoning Township police for an incident at the Giant Market where he stole a shopping cart full of items.On the first DUI, Nanovic sentenced him to serve 72 hours to six months in jail, a fine of $1,500, and a one-year license suspension. On the second DUI he was sentenced to serve 93 days to five years in jail, a fine of $1,500 and an 18-month license suspension. The jail terms run concurrently.On the theft charge, he was placed on probation for two years concurrent with the DUI charges. He must make restitution to Giant for $135.79.Heckman, an inmate in the county prison, has a detainer on him filed by the adult probation office for a probation violation.He was granted work-release privileges.Gerard George Nieroda,23, of Kunkletown, was sentenced to serve five days to six months in jail, pay a fine of $300 and one-year license suspension on a DUI charge. He was also sentenced to serve 90 days in prison and a fine of $1,000 on a driving under suspension-DUI related charge with the terms running concurrently.He is currently an inmate in the county prison on a pending simple assault charge and will remain there to serve the DUI sentence.Andrew Lee Alvarez,29, of Lehighton, was sentenced to serve 90 days to five years in jail, pay a fine of $1,500 and his license was suspended for 18 months.On a charge of driving under suspension-DUI related he was sentenced to serve 90 days in jail and a fine of $1,000. The jail term is concurrent with the DUI charge. On a charge of endangering the welfare of children he was sentenced to serve three to one day less 24 months, concurrent with the other charges. He was also ordered to get a drug and alcohol evaluation.He was charged by Lehighton police on May 3. At the time of the traffic stop, Alvarez had two children, ages 2 and 8, in the car.He was denied placement in the Intermediate Punishment Program because of prior revocations in Lehigh County and other criminal convictions. He also has a pending case in Carbon County.He will begin the jail term at 11 p.m. Nov. 18 and serve it on consecutive two-day weekends.John William Krupa,62, of Northampton, was sentenced to serve 30 days in the county prison followed by 59 months in the IPP with the first 60 days on electronic monitoring. He must also pay a fine of $1,500 and his license was suspended for 18 months.Krupa was charged by state police at Lehighton on May 20, 2015. He was also charged with having prescription drugs he was not authorized to have. It is his second such offense, Nanovic said. Krupa, a pharmacist, said he is in a recovery program sponsored by a pharmacy support group and spent 12 days in an inpatient program.Nanovic gave him credit for the 12 days against the 30. He will begin his jail term at 8:30 a.m. Nov. 18 and serve it on consecutive three-day weekends.Each defendant must also pay court costs of about $1,000, pay a $50 per month supervision fee while on probation or parole, and follow any recommendations of their drug and alcohol evaluation.
