Candidate questions cross-filing rules

A Jim Thorpe school board candidate has some issues with Carbon County regarding the handling of his filing.

On Thursday, Matthew Schutter of Penn Forest Township approached the county election board to discuss his recent experience with filing for the upcoming election as a candidate for a school director. Schutter was previously a candidate for state representative, but was defeated by incumbent state Rep. Doyle Heffley.He told the commissioners that he wanted to cross-file as a Libertarian for the upcoming primary election, but was told by Lisa Dart, elections director, in January that he could not.Schutter claimed that this denial was a violation of the 14th Amendment, because Republicans and Democrats are allowed to cross-file."If you can allow Republicans and Democrats to cross-file, you need to allow third parties or Independents," he said.Schutter then told commissioners that he told Dart that he would just change his registration to Democrat and would circulate a petition and have a Republican also circulate his petition. After the petitions were completed, he would then change his registration back to Libertarian, but was told he could not do that either."She forced me to invade your party by not allowing me to do it as a Libertarian," Schutter said to Commissioner William O'Gurek, who asked a few questions regarding the cross-filing.Schutter went on to say that additional action taken by Dart, in his belief, constituted fraud and asked the commissioners to look into the legality of her asking for the Libertarian's bylaws and nomination forms and said that Carbon was the only county his party ever had trouble working with in the region.Commissioners' Chairman Wayne Nothstein said they would speak with the solicitor regarding this matter and would get a response to him.Schutter asked if it would be by the end of business on Thursday, adding that if it wasn't, he would consider legal actions to get his answers.Nothstein responded that it would not be by the end of the day, because it may take some time to do the research and said that he will get an answer when the county has one available.Commissioner Thomas J. Gerhard then asked if Schutter could submit his questions to the county in writing, to which Schutter said he would not and said the county would then hear from his lawyer."Request denied," he said. "If you're not going to work with me, I'm not going to work with you."
