A Carbon County judge conducted parole/probation hearings recently on petitions filed by the adult probation office against defendants in criminal matters who have violated the terms of their release.
Judge Joseph J. Matika heard the following cases.Jeffrey Dolinsky,52, of Weatherly, had his parole revoked on a driving under the influence charge on petition of probation officer Joseph Bettine for violating conditions by missing a scheduled urine screen, which violated the zero-tolerance condition.Matika resentenced him to serve 104 days "street time" effective back to Oct. 9, 2015, with the three years consecutive probation term still in full force.Christopher Miller,25, of Weatherly, had his probation revoked on a charge of access device fraud on petition of Bettine for violating conditions by testing positive for alcohol, not making a concerted effort to pay court costs, violating the zero-tolerance condition, failing to complete drug and alcohol treatment and failing to complete 75 hours of community service.Matika resentenced him to serve three to six months in the county prison effective May 2. However, if he completes the drug and alcohol treatment, the 75 hours of community service and pays $350 in court costs, along with his regular monthly payments, by that date the order will be vacated.Barbara Montana,62, of Albrightsville, had her placement in the county's Accelerated Rehabilitation Disposition probation program revoked on a charge of DUI on petition of Bettine for violating conditions by being arrested for another DUI.Matika ordered the case place on the Feb. 25 pretrial list.
