Eight first-time offenders were placed in Carbon County's Accelerated Rehabilitation Disposition probation program on Monday by President Judge Roger N. Nanovic II.
If a person successfully completes all conditions of the program their record his wiped clean. However, if they fail complete it, or are revoked from it, then they would face trial on all pending charges. A person does not admit guilt in entering the program.All were placed for a year, unless otherwise noted.David Paul Grafe, 50, of Landing, New Jersey, was placed for six months on a charge of access device fraud. He was charged by state police at Fern Ridge for an incident on Sept. 13, 2016, in whichhis wife is the listed victim.He was assessed $450 for the cost of the program and ordered to make restitution in an amount to be determined by the adult probation office.Tracey Guillory, 23, of Lehighton, was placed on charges of driving under the influence and endangering the welfare of a child. He was arrested on Sept. 30, 2016, along the 300 block of South Second Street by Lehighton police. A 15-year-old juvenile was in the vehicle at the time. A test revealed the presence of a controlled substance.She was assessed $600 and her license was suspended for 60 days.Scott Richard Kobal, 52, of Nesquehoning, was placed for six months on a charge of terroristic threats. He was charged by Jim Thorpe police for an incident on Sept. 11, 2016, in the area of 627 North St., involving officer Kyle Rohler as the victim.He was assessed $450 and ordered to get a mental health evaluation.Daniel Ryan Nonnemacher, 29, of Saylorsburg, was placed on a charge of DUI. He was arrested on July 9, 2016, by state police at Lehighton in the area of 2685 Little Gap Road, in Lower Towamensing Township. A test revealed a 0.18 BAC.He was assessed $550 and his license was suspended for 60 days.Andre Simmons, 37, of Freeland, was placed on a DUI charge. He was arrested on Jan. 13, 2016, by state police at Fern Ridge. A test revealed the presence of a controlled substance.He was assessed $600 and his license was suspended for 60 days.Bryan Paul Braker, 23, of Palmerton, was placed on a DUI charge. He was arrested on March 22, 2015, along Forest Inn Road in Franklin Township by state police at Lehighton. A test revealed a 0.10 BAC.He was assessed $650 and his license was suspended for 60 days.Monseur J. Gonda III, 43, of Wilkes-Barre, was placed on a DUI charge. He was arrested on May 9, 2015, by state police at Lehighton along Route 903 in Penn Forest Township. He refused a blood test.He was assessed $600 and his license was suspended for 60 days.Michael Anthony Ressler Jr., 24, of Danielsville, was placed on a DUI charge. He was arrested on May 2, 2016, along Route 209 by Jim Thorpe police. A test revealed a 0.13 BAC.He was assessed $500 and his license was suspended for 60 days.Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while in the program and those charged with DUI must follow all recommendations of their drug and alcohol evaluation.
