Resident says neighbor’s hedges block his mailbox

A Lower Towamensing Township man has threatened legal action against the municipality over a row of hedges from a neighboring property that he says obstructs his mailbox.

Terry Kuehner, of 2305 Stoney Ridge Road, told township supervisors last week that a neighboring property has a row of hedges that he believes is in the township’s right of way.

Kuehner told supervisors he has installed a mailbox on his property toward that neighboring property, and claimed that the letter carrier was unable to get to his mailbox because of the hedges.

Kuehner called upon board chairperson Connie Brown to have the township’s road foreman correct the situation.

Township solicitor Jim Nanovic said to Kuehner that he previously told him to talk to the postmaster.

Kuehner said he did what they required, and again requested that the township remove obstructions to clear the mailbox.

“I just want to try to resolve a simple issue,” Kuehner said. “What I want you to do is your job.”

Kuehner added that whoever approved the subdivision plan did it illegally.

“If there’s an accident there, you’re liable,” he said. “If something happens and there’s an accident, I know who they’re coming after.”

Nanovic told Kuehner he disagrees with his interpretation.

Kuehner added he just wants the problem resolved, and he’s giving the board 30 days.

Supervisor Jay Mullikin asked Kuehner if he could simply move his mailbox.

Township planning commission member Angela Farrell told Kuehner that he has a 25-foot easement.

“A mailbox you can potentially relocate within your 25-foot easement,” Farrell said. “It is your problem, not the township’s problem.”

Township code enforcement officer Brent Green asked Kuehner if he got notice from the post office.

Mullikin told Kuehner that if he’s getting his mail, then he wasn’t sure what exactly the problem is.

Kuehner said the issue is the easement of the township’s right of way and why it isn’t clearing it.
