Man faces drug charges after assault arrest

A man charged with striking another man in the head with an object is now facing drug charges.

According to the affidavit of probable cause filed by Narcotics Agent Matt Pavlik of the Pennsylvania Office of Attorney General, Bureau of Narcotics Investigations, in the case against Kyle Kubin:

On March 27, Pavlik received information from a reliable source that Kubin, 41, homeless, was staying at a home in the 500 block of Behrens Road in Jim Thorpe and would be leaving in the afternoon.

Kubin was confirmed to have an active arrest warrant from the Franklin Township Police Department for felony aggravated assault, along with other charges.

Agents saw Kubin get into a silver Buick SUV and go to a Sunoco Gas Station along Blakeslee Boulevard in Lehighton.

When the vehicle stopped at a fuel pump, agents along with Lehighton Borough and Franklin Township police officers conducted a felony stop of the vehicle.

Kubin was in the back seat of the vehicle and was taken into custody without incident.

Where Kubin was sitting, Pavlik observed several plastic bags containing controlled substances, a digital scale and a black bag also containing additional controlled substances packaged for sale.

Kubin admitted the bags were his.

The bags were recovered and brought to the Lehighton Borough Police Department. The black bag had 321 grams of crystal methamphetamine, 32.8 grams of heroin/fentanyl and 41.5 grams of cocaine.

A random sample of the suspected crystal methamphetamine and heroin were tested and indicated a positive reaction for the presence of their respective substances.

Kubin said he was planning to sell the recovered drugs to pay for a lawyer to obtain bail money because he knew about the active aggravated assault warrant filed against him.

Kubin also stated that he was doing the community a favor because he was not only selling “brown dope (heroin) that has no fentanyl or tranq (Xylazine) in it.”

Kubin stated that he was helping people “get off fentanyl.”

Kubin faces charges on three counts each of possession with intent to deliver a controlled substance and possession of a controlled or counterfeit substance; and one count of possession of drug paraphernalia.

He is currently incarcerated in the Carbon County Correctional Facility in lieu of $50,000 monetary bail, and scheduled to have a preliminary hearing Wednesday before District Judge Eric M. Schrantz of Jim Thorpe.
