Man charged with stealing window

A Lehighton man has been charged with stealing a window from a business.

According to the affidavit of probable cause filed by patrolman Jason Pryce of the Lehighton Borough Police Department in the case against Cody Moser:

At 3:31 a.m. Jan. 25, Pryce was patrolling on South Ninth Street and while passing St. Luke’s Care Now, saw a pickup parked in the far corner of the parking lot next to a trailer and a Bobcat skid steer.

Pryce stopped and the vehicle’s headlights went on and the vehicle started traveling toward the exit. Pryce pulled into the entrance and the vehicle traveled straight at the police cruiser. Police swerved out of the way and hit a snow bank.

Pryce went after the truck which started traveling north on Ninth Street and saw the vehicle had no license plate on it.

The truck almost struck another vehicle that was parked on the side of South Ninth Street and then continued to drive onto the sidewalk and stopped abruptly.

The driver, identified from previous incidents as Moser, 31, had enlarged pupils and slurred speech.

The inspection on the vehicle was also expired as of November 2023. Moser was asked why he was driving and he started to throw garbage away. Pryce asked Moser if he had a license and he said it was suspended.

When Moser was asked where he was throwing the garbage, he stated he was throwing it on the trailer in the parking lot because there was not a dumpster in the parking lot, but when Buss and Pryce looked there was still garbage in the back of the truck and a window.

The truck was towed by All Points Towing and transported to St. Luke’s Care Now to match up the door/window of the skid steer.

While at St. Luke’s Care Now Pryce ran the registration on the trailer and it came back to Potak Landscaping LLC. Pryce acquired the owner’s number from PSP Lehighton troopers and contacted the owner regarding the skid steer.

While waiting for the owner to arrive on scene, Pryce asked Moser to a blood test and he said, “No because I am going to get a DUI regardless.”

The owner arrived at St. Luke’s Care Now and identified that to be the door/window that belongs on his skid steer. The window is valued at between $2,000 to $2,500.

The truck was then towed to the police station and placed in the garage bay. A small silver key that is universal for skid steers was found in Moser’s right front pocket.

Police searched the vehicle and found a pry bar, gloves, four-way tire iron, and hydraulic hose disconnect tools.

Moser faces charges on two counts of recklessly endangering another person, and one count each of theft by unlawful taking, receiving stolen property, DUI: controlled substance, criminal mischief, reckless driving, driver’s license suspended/revoked, operating vehicle without valid inspection, and improper display plate.

He is in the Carbon County Correctional Facility in lieu of $150,000 bail, and scheduled to have a preliminary hearing Wednesday before District Judge Eric M. Schrantz of Jim Thorpe.
