2 charged for roles in drug overdose death

A Saylorsburg pair have been charged for their role in a 2022 drug overdose death in Monroe County.

According to the affidavit of probable cause filed by Cpl. Leo Petrucci and Detective Thomas McMahon in the case against Jennifer Hoffman and Anthony Chiquillo-Cardozo:

At 11:56 a.m. Aug. 10, 2022, members of the Pennsylvania State Police, Lehighton barracks, were dispatched to a home in the 100 block of Heiney Lane, Polk Township, to assist an ambulance with an unresponsive 26-year-old man.

Troopers helped Lehigh Valley Ambulance personnel with resuscitation attempts. The man, identified as Justin Smith, was transported to St. Luke’s Hospital, Carbon Campus, and was pronounced dead at 12:48 p.m. by Dr. Jarrett Shugars.

Police had observed a white residue in Smith’s nose. He had been found on his bed unresponsive by his mother. Drug and drug paraphernalia items were visible in the bedroom.

Police found waxine bags in Smith’s 2003 Jeep Liberty and outside on the ground next to the right front tire.

A search warrant was obtained and troopers removed the following from his bedroom: three white ripped waxine baggies from a shelf; three cut plastic straws from Smith’s bed; two glass smoking devices with residue from the floor; five white ripped waxine baggies stamped “Ovo”; one clear zip baggie containing several white waxine baggies, some plain and others stamped “Pepsi”; three small clear plastic zip baggie; one clear zip baggie containing ripped waxine baggies stamped “My Turn” and “Me & You”; and small clear plastic baggies and ripped green straws.

Seized from the Jeep were: one AT&T Radiant Max 5G smartphone; one cut plastic green straw; and five white waxine baggies with residue.

Lab results found the zip baggie containing five partial white glassine pockets with residue contained heroin and fentanyl; the zip baggie containing 38 crumpled pieces of white glassine packets contained fentanyl; and three glass pipes contained methamphetamine residue.

On Aug. 11, 2022, an autopsy of Smith was performed.

Police determines Hoffman, 33, and Chiquillo-Cardozo, 34, were responsible for the drug sale.

Both face two counts of manufacture, delivery or possession with intent to manufacture or deliver, and one count each of drug delivery resulting in death; conspiracy — drug delivery resulting in death; criminal use of communication facility; deal in act/intent to promote; involuntary manslaughter; and conspiracy — manufacture, delivery or possession with intent to manufacture or deliver.

Both are jailed in the Monroe County Prison in lieu of $100,000 cash bail each. Preliminary hearings before Kresge are scheduled for Oct. 10.
