Police: Man showed explicit material to juvenile

A Tresckow man is jailed on charges that he showed explicit sexual material to a juvenile.

Maurice D. Foster Jr., 34, waived a preliminary hearing Wednesday before Magisterial District Judge Joseph D. Homanko Sr. of Weatherly.

Foster is in the Carbon County Correctional Facility in lieu of $100,000 straight cash bail.

According to the affidavit of probable cause filed by state police Trooper David DeWitt of the Hazleton barracks:

Around 6:28 p.m. June 28, DeWitt interviewed a juvenile, who said that she had previously been the victim of sexual assault and is not permitted to use any cellular device or computer for fear of rumination.

Throughout June 24-28, Foster, 34, had been asking the juvenile if she knew what pedophiles were.

On June 25, the juvenile was showering when Foster brought her a towel. On June 26, Foster asked the juvenile to get him a towel while he was in the shower. The juvenile retrieved a towel from the dryer where his cellphone was open and unlocked. A note was open on the phone that read, “I saw your chest yesterday while you were in the shower, don’t tell (unknown person). Can you please bring me a towel and I will let you use my old cellphone so you can talk to your friends on Snapchat. But don’t tell (unknown person), followed by a shushing emoji. The juvenile threw the towel in the bathroom and left.

On June 28, Foster gave the juvenile his old cellphone, which the juvenile was hesitant to take as she thought she may be set up to get in trouble.

The juvenile went on Foster’s old cellphone, where she was already logged into her Snapchat account and observed a new message from “Nonya,” but she had not added “Nonya” as a friend and was unsure of who it was.

The juvenile opened the message and observed a male’s private parts.

The juvenile was distraught and immediately brought the phone back to Foster, asked him who sent the message and placed the phone in Foster’s top dresser drawer.

Foster asked the juvenile is she knew who sent it. Later on, Foster was in the shower and asked the juvenile to bring him a towel, and then asked the juvenile if she knew who that was, to which the juvenile replied no.

Foster asked the juvenile once again, and the juvenile replied no again and began walking away. The juvenile heard Foster whisper “it was me,” and when the juvenile asked “what,” Foster stated “it was me.” The juvenile then fled.

On July 1, DeWitt obtained a search warrant for the juvenile’s Snapchat account, which was served on Snap Inc.

Around 3:42 p.m. July 16, DeWitt received the search warrant results. There were three occasions in which a chat was sent to the juvenile’s username.

On Aug. 7, DeWitt prepared a search warrant for a Snapchat account user name, which was approved by Carbon County Assistant District Attorney Michael Greek and Judge Joseph Matika. The warrant was served on Snap Inc. at 1:54 p.m. Aug. 7.

At 11:54 a.m. Aug. 8, DeWitt received the search warrant results for the Snapchat account username for which the account was created on April 9 and has a verified phone number matching that of Foster’s. The birth date associated with the account is Feb. 20, 1990, which matches that of Foster.

Foster is charged with dissemination of explicit sexual material of a minor, unlawful contact with a minor — open lewdness, unlawful contact with a minor — obscene and other sexual materials and performances, dissemination of explicit sex material via electronic communication, open lewdness, harassment and corruption of minors.
