JT asked to allow food truck at business

A craft brewery on the east side of Jim Thorpe is asking borough council to consider a waiver that would allow a food truck to operate on the premises during its Saturday operating hours.

Hairy Guys Brewing, run by locals Tim Benyo and Tommy Whitehead, said vendors aren’t currently allowed to obtain a transient retail license from the borough because an ordinance prohibits it in a residentially zoned area.

The brewery, which opened last year, is located at 204 Center St. in a leased space next to Union Publick House.

“We’ve had food trucks here in the past on Saturday, but their transient license was revoked after it was discovered the ordinance only allows for that in commercial zones,” Benyo said. “The trucks, when they are here, are located in our private parking lot and the gentleman we lease the property from is fully supportive of it. The permits cost $30 and we are estimating that would bring around $1,500 per year into the borough.”

Council President Greg Strubinger said the governing body would consult its solicitor before moving forward.

“We just want to verify with him that we have the authority to grant a waiver and that this doesn’t have to go before the zoning hearing board,” Strubinger said Thursday.

Benyo and Whitehead went before Jim Thorpe’s zoning hearing board last April to gain special exception approval to open the brewery and taproom in a residential district.

“It’s our intention to be very non-intrusive and keep the neighbors happy,” Benyo said after that hearing.

On Thursday, Benyo updated council and said the business has “not received complaints from neighbors” since its opening.

“We have two spots laid out for the trucks and it leaves plenty of space for everyone to still be able to come and park,” he said. “We’re open from 1-8 p.m. on Saturdays and that is the only day we’re looking for with the trucks.”
