Ben Price of Bowmanstown, a business partner of Councilwoman Kara Scott, addressed the borough’s Water Authority at Tuesday’s meeting.
“Two years ago, my partner, Kara Scott, brought suit against the authority for charging us for an extra EDU (Equivalent Dwelling Unit) and increased fees per month,” Price said. “The verdict came in our favor on Jan. 19, and what I wanted to do is read the conclusions of the law and the verdict to the board in case they haven’t actually looked at it themselves. The court, Judge (Steven) Serfass ordered that reimbursement of the funds be made within 30 days of the order. Today (Feb. 20) is the 31st day, and that has not been done. So I want to bring that to their attention in case they’re not aware of it.”
Price asked to read the verdict to the authority but members said they were aware of the verdict. Price again requested to read it.
“I just remind the board we’re still under litigation in his matter,” Borough Solicitor Neil Ettinger said.
Price had two minutes to read from the verdict. The Water Authority stopped him at the end of the two minutes, although Price continued to read aloud. After concluding, Price left the room, and no actions were taken.
A Reconsideration of the court is scheduled for April 2. The Water Authority has not yet appealed the decision, but could do so pending the outcome of the court’s action in April.
For a property, each EDU carries with it a $3,000 tapping fee plus monthly fees.
