Board OKs agreement for Dollar General

Slowly but surely, a proposed Dollar General in Mahoning Township continues to inch its way toward becoming a reality.

The township’s board of supervisors at a special meeting Thursday unanimously approved a preconstruction agreement for Dollar General.

However, the board didn’t take any action on the development, stormwater operating and maintenance agreements, and letter of credit.

Cole Boyer, project engineer for JLM Investments LLC, and attorney Gretchen Stearns, legal counsel, were in attendance.

The plans call for building a 10,700-square-foot store with 32 parking spaces. JLM Investments LLC is the project engineer for the project, while the site is owned by Duschak One LLC.

Last month, supervisors tabled the development, stormwater operating and maintenance agreements, and letter of credit.

In July, the board had signed a preconstruction agreement with Starbucks that enabled the company to begin doing some earth moving, but they couldn’t start to put up their building until the supervisor signed off on agreements, In October, the board tabled those matters concerning Starbucks because they only received the information a short time before the meeting.

Township solicitor Tom Nanovic had prepared the development agreement and stormwater agreement for Dollar General almost identical to Starbucks, but the attorney for Dollar General made changes to what Nanovic had drafted.

Essentially, Dollar General wanted to know if it could enter into a preconstruction agreement the same way Starbucks did back in July, and their attorney prepared an agreement.

Boyer brought the agreement to the meeting last month, but Nanovic hadn’t seen it yet.

Supervisor Deb McGowan and board Chairman Robert Slaw tabled the agreement at that time, saying they were uncomfortable because they hadn’t seen it yet.

The former Bill’s Bakery was leveled to make way for a Dollar General along Route 443 just east of the Normal Square intersection.
