Police say man illegally taped conversation

A Brodheadsville man has been charged with illegally video recording a phone conversation during a disturbance complaint.

According to the affidavit of probable cause filed by state police at Fern Ridge in the case against Anthony Palmer:

At 6:39 p.m. Aug. 9, troopers were dispatched to Route 209 in reference to a disturbance complaint in regard to the caller and another tenant closing the upstairs door too loudly.

Police interviewed the men who said they were partners and co-owned the building and also did maintenance on the building.

They said they were there to change the door handles of the common doorways of the building. One co-owner said he had received a recording of him speaking with the tenant Palmer, 27, on his cellphone by a text message.

The man said he felt harassed by this video and did not know why Palmer sent it to him.

The man said he did not give consent to be recorded by Palmer when calling Palmer about issues with the apartment.

The man, who is the co-owner of the apartment building, said during the interview that he had received a text message from Palmer at around 1:18 p.m. Aug. 7 containing a video of the oral communication intercepted by Palmer said that he knew the recording/interception of the oral communication between himself and Heinze was a violation of the Wiretap Act in Pennsylvania.

The video is about 4 minutes long, and in it, police can see Palmer sitting on a bed in the apartment with his iPhone on speaker as another person is present in the room wearing gray sweatpants and is using a second electronic device to record the video.

The screen of the iPhone belonging to Palmer is displayed in the video and police can see a telephone number at the top of Palmer’s iPhone screen, and can hear conversation between Palmer and the landlord regarding an issue with the water in the apartment and in the building.

Palmer faces charges of intercept communications, disclose intercepted communications, and harassment.

Palmer is scheduled to have a preliminary hearing Nov. 2 before District Judge Colleen Mancuso of Brodheadsville.
