Woman faces hearing in case that went viral

A Weissport woman forcibly removed from her vehicle July 4 after a Lehighton Borough police officer said she failed to comply with his requests during a traffic stop is scheduled for a preliminary hearing next month.

Corporal Bruce Broyles, in an affidavit of probable cause, said he stopped a white Mercedes-Benz sedan driven by Constance Miller, 58, just before 2:30 p.m. because the vehicle had no inspection sticker or registration plate.

A passenger inside the vehicle filmed the interaction and the video has been posted on the YouTube channel “Lehighton Police Brutality.” The video from inside the vehicle eclipsed 8,000 views as of Thursday morning.

The hearing is scheduled for Aug. 9 at 1:45 p.m. in front of Magisterial District Judge Eric Schrantz.

Broyles said he tried to initiate the stop on Bankway Street and “after passing several open parking stalls,” the vehicle pulled over in the J&K Cigarette Outlet lot.

Miller, he said, cracked the window just slightly and immediately asked for his name and badge number, which he provided.

When asked for her driver’s license and registration, Miller told Broyles she was not required to possess these items because she was “a traveler.”

“I ordered the driver to exit the vehicle, which she said she would not do,” Broyles said. “After giving this order several times, the driver was advised if she failed to comply with my directives, the window would be broken and she would be forcefully removed from the car.”

After Miller again stated she would not comply, Broyles tried to open the door via its handle, but the car was locked. He then tried to push the window down in order to manually unlock the door.

Upon another request for Miller to exit, she refused and Miller said he “used a window punch and forcefully opened the door.”

“I took possession of the driver’s arm, where she immediately pulled away from me and said she would not exit,” Broyles said. “The driver further used the seat belt she was wearing as leverage to keep herself in the car. As I attempted to remove the driver, a rear female passenger was pulling her back into the vehicle.”

After what Broyles described as a “demanding struggle,” he was able to remove Miller from the car and secure her in handcuffs without further incident.

A records check showed the vehicle’s registration had been suspended following a conviction of driving without insurance.

Miller faces charges of obstruction of law enforcement, improper display of registration plate, driving an unregistered vehicle, vehicle registration suspended, operating a vehicle without a valid inspection and operating a vehicle without the required financial responsibility.

She was arraigned on July 5 and unsecured bail was set at $2,500.
