Carbon County Court - guilty pleas
Carbon County Court Judge Steven R. Serfass recently accepted guilty pleas from four people.
Alan Daniel Kovacs, 34, Summit Hill, was charged by state police at Fern Ridge with driving under the influence of a controlled substance, schedule 2 or 3 drugs, second offense; careless driving; failure to use safety belts, driver and front seat occupant; violating hazard regulations; and driving without a license on Dec. 29, 2021.
He pleaded guilty to the DUI charge; the other charges were dropped.
Judge Serfass sentenced Kovacs to serve 90 days to 60 months in Carbon County Prison, with two days credit for times served; fined him $1,500; ordered him to pay court costs; a $100 LiveScan fee and a $50 monthly supervision fee; submit a DNA sample and pay the $250 fee; complete Alcohol Highway Safety School; serve 100 hours of community service; and surrender his license for 18 months.
Thomas Anthony Weiss, 54, Lehighton, was charged by state police at Leighton with driving under the influence of a controlled substance, impaired ability, first offense; driving an unregistered vehicle; driving while his operating privileges were suspended or revoked; careless driving; reckless driving; operating a vehicle without a valid inspection sticker; and displaying a known fictitious or stolen/inspection sticker on Aug. 6, 2020.
Judge Serfass ordered him to serve 72 hours to 6 months in Carbon County Prison, to be served at the same time as a sentence for a previous crime; pay court costs; fined him $1,000; pay a $50 monthly supervision fee; undergo a drug and alcohol evaluation; serve 25 hours of community service; and surrender his license for 12 months.
David Michael Schrader, 51, Philadelphia, was charged by State Police at Fern Ridge with possession of a controlled substance and possession of drug paraphernalia on March 4, 2019.
He pleaded guilty to the substance charge. The paraphernalia charge was dropped.
Judge Serfass ordered him to serve 12 months to 624 months in Carbon County Prison, with credit for 206 days served, to be served at the same time as a sentence for a previous crime; and with “zero tolerance” for alcohol, drugs, non prescribed medications, and missed drug tests/urine screens.
In another case, Schrader was charged by Kidder Township Police with aggravated assault; with a deadly weapon; simple assault; and harassment on June 26, 2019.
In that case, he pleaded guilty to simple assault. The remaining charges were dropped.
Serfass ordered him jailed for 12 to 24 months.
In third case, Schrader was charged by state police at Fern Ridge with possession of a prohibited firearm; firearms not to be carried without a license; driving under the influence, impaired ability, first offense; driving under the influence, highest blood alcohol ratio, first offense; driving with a blood alcohol content of 0.02 or greater while his license was suspended; careless driving; and driving without headlights on March 20, 2018.
In that case, he pleaded guilty to carrying a firearm without a license; DUI; and DUI with a blood alcohol content of 0.02 or greater while his license was suspended. The remaining charges were dropped.
Serfass sentenced him to 18-36 months in prison on the firearms charge; six months probation on the DUI charge, also ordered Schrader to undergo a comprehensive drug and alcohol evaluation and follow all course of treatment, participate in and successfully complete the Alcohol Highway Safety Program, and have “zero tolerance” for alcohol, drugs, non prescribed medications, and missed drug tests/urine screens. He was immediately eligible for parole.
On the charge of driving with a blood alcohol content of 0.02 or greater while his license was suspended, Serfass sentenced Schrader to no further penalty.
Joseph Albert Roscioli, 41, Lehighton, was charged by Leighton Borough Police with driving under the influence of a controlled substance, first offense; driving while his operating privileges were suspended or revoked; and not having taillights illuminated on July 2, 2021.
He pleaded guilty to driving under the influence of a controlled substance.
Serfass sentenced him to serve 72 hours to six months in prison; to undergo a comprehensive drug and alcohol evaluation and follow all course of treatment recommended; to participate in and successfully complete the Alcohol Highway Safety Program; pay a $100 LiveScan fee and a $50 monthly supervision fee; and to render 25 hours of community service.
Roscioli was also fined $1,000 and lost his license for 12 months.
