Carbon County Judge Joseph J. Matika accepted eight people charged with impaired driving into the Accelerated Rehabilitative Disposition program for one-year terms.
Acceptance into the program, for first-time, non violent offenders, is not an admission of guilt. Defendants may have their records expunged if they successfully complete the program.
Mark Anthony Bauder Jr., 31 of Nesquehoning, was charged with driving under the influence of a controlled substance/impaired ability, first offense; driving under the influence of a controlled substance/schedule 1 drug, first offense; and off-road lighting on Sept. 27, 2022.
Judge Matika ordered him to pay $600 to offset the cost of the program plus a $50 monthly supervision fee; pay a LiveScan fee of $100; to successfully complete the Alcohol Highway Safety School and a treatment intervention group; and to perform 50 hours of community service.
Bauder’s license is suspended for 60 days.
Joseph T. Dait, 33, of Palmerton, was charged with driving under the influence, highest rate of alcohol, first offense; driving under the influence, incapable of driving safely, first offense; reckless driving; careless driving; and disregard traffic lanes on Aug. 28, 2022.
Judge Matika ordered him to pay $500 to offset the cost of the program plus a $50 monthly supervision fee; pay a LiveScan fee of $75; enroll in outpatient treatment; and to perform 50 hours of community service.
Dait’s license is suspended for 60 days.
Joseph Robert De La Cruz, 32, of Weatherly, was charged with driving under the influence, highest rate of alcohol, first offense and driving under the influence, incapable of driving safely, first offense on Aug. 22, 2022.
Judge Matika ordered him to pay $500 to offset the cost of the program plus a $50 monthly supervision fee; pay a LiveScan fee of $100; to successfully complete Alcohol Highway Safety School; and to perform 50 hours of community service.
De La Cruz’s license is suspended for 30 days.
Michelle A. Garavuso, 40, of West Hazleton, was charged with driving under the influence of a controlled substance/impaired ability, first offense; possession of a controlled substance; possession of a small amount of marijuana; no headlights; disregarding traffic lanes and careless driving on Jan. 27, 2022.
Judge Matika ordered her to pay $600 to offset the cost of the program plus a $50 monthly supervision fee; pay a LiveScan fee of $100; and to perform 50 hours of community service.
Garavuso’s license is suspended for 60 days.
Nathan J. Grimm, 23, of Northampton, was charged with two counts of driving under the influence of a controlled substance or metabolite, first offense; and driving under the influence of a controlled substance/impaired ability, first offense.
Judge Matika ordered him to pay $600 to offset the cost of the program plus a $50 monthly supervision fee; pay a LiveScan fee of $75; to successfully complete Alcohol Highway Safety School; and to perform 50 hours of community service.
Grimm’s license is suspended for 60 days.
Reinardo Mendez Jr., 27, of Philadelphia, was charged with driving under the influence driving under the influence of a controlled substance or metabolite, first offense; driving under the influence of a controlled substance/impaired ability, first offense; possession of a small amount of marijuana; disregarding traffic lanes and careless driving on Oct. 22, 2022.
Judge Matika ordered him to pay $600 to offset the cost of the program plus a $50 monthly supervision fee and to perform 50 hours of community service.
Mendez’s license is suspended for 60 days
Hunter Lee Rausch, 20, of Lehighton, was charged with display of registration plate; not wearing proper headgear on motorcycle; driving under the influence of a controlled substance/schedule 1 drug, first offense; driving under the influence of a controlled substance/impaired ability, first offense; driving without a license; no rear lights; driving an unregistered vehicle; operating a vehicle without insurance; and careless driving on July 29, 2022.
Judge Matika ordered him to pay $600 to offset the cost of the program plus a $50 monthly supervision fee; to successfully complete Alcohol Highway Safety School; enroll in a treatment intervention group; and to perform 50 hours of community service.
Rausch’s license is suspended for 90 days.
Ashley Rinker, 25, of Walnutport, was charged under the influence, highest rate of alcohol, first offense and driving under the influence, incapable of driving safely, first offense on Sept. 2, 2022.
Judge Matika ordered her to pay $500 to offset the cost of the program plus a $50 monthly supervision fee; pay a LiveScan fee of $100; and to perform 50 hours of community service.
Rinker’s license is suspended for 60 days.
