Man assaults another, takes his money

A Lansford man has been extradited from Florida, and is being changed in Carbon County with assaulting a man and taking his money.

According to the affidavit of probable cause filed by Sgt. Shawn Nunemacher of the Lansford Police Department in the case against Xavier Olivero:

At 10:30 p.m. Aug. 4, an armed robbery complaint came in and officers were dispatched to a home in the 200 block of West Abbott Street where a man was found visibly upset and bleeding from the left side of his face.

The victim stated that he was outside at his truck when he was approached by two males he knew from prior contacts, one of whom was Olivero, 23. The victim said he was struck by another male, which caused him to fall.

The victim said both males had handguns and pointed at him and told him to give them his money. Upon getting the money, the two males fled east on Abbott Street.

The victim was transported via EMS to St. Luke’s Miners for his injuries. Summit Hill police Sgt. Jeffrey Ohl checked the surrounding areas and could not locate anyone fitting the description of the two males.

On Aug. 5, Nunemacher followed up with the victim, who had a cut on the left side of his face and scratch marks on his chest/neck area. The victim turned over hospital paperwork that stated he suffered a laceration and fracture to his face from the assault.

The victim told Nunemacher he was outside at his truck when the two males he knew came down the street and he stopped what he was doing to say hi. Olivero immediately walked behind him, and when the victim turned back around, he was struck in the face by the other male.

The victim said he attempted to defend himself, and as he was fighting the two males off, he attempted to run back into his gate to get inside his residence. He closed the gate and turned to run toward his door, at which time the other male grabbed him by the shirt and was pulling him over his gate. While struggling, the victim witnessed the male remove a handgun from his right hip area, at which time the victim tried to roll away from the gun, but Olivero then jumped over his fence from the neighbors’ side and blocked the path to his door.

The victim said he witnessed Olivero remove a handgun from his upper right vest pocket, and both males began yelling for him to give it to them, at which time he grabbed his loose cash which was about $80 from his wallet and threw it down to the side. The victim said Olivero had his gun pointed at him, but when he witnessed the victim throw the money, he went for the money, and the other male also released him and he was able to run inside his residence. The victim said that after picking up the money, both males fled east on Abbott and then turned north on Centre Street.

Nunemacher checked the outside of the victim’s residence and located several blood spots on the ground by his front gate. Photos were taken of the spots, and Nunemacher also checked the neighbors’ residences for cameras and located several and obtained footage. Nunemacher was able to locate Olivero, and a photo lineup was made and shown to the victim, who immediately picked out Olivero and identified him as one of the attackers.

Nunemacher was able to locate an individual who was listed as relation to Olivero and shared prior residences together. A photo lineup was created and shown to the victim, who immediately picked out the other male and stated that was his second attacker. Nunemacher was able to get security footage from a neighbor at the intersection of Abbott and Centre Street, which showed that at 10:21 p.m., two males were seen coming up from Centre Street; one had light-colored clothes and the other dark clothes. The males walked west on Abbott Street, and at 10:23 p.m., yelling could be heard.

Nunemacher then went to the last known residence for the two males in the 300 block of East Bertsch Street, but was not able to make contact with anyone and did not locate any vehicles out front of the residence. Nunemacher found that Olivero had an active felony warrant for illegal possession of a firearm, and firearm with an altered serial number.

Olivero faces charges on two counts of simple assault, and one count each of robbery, criminal conspiracy, aggravated assault, and theft by unlawful taking.

He is currently incarcerated in the Carbon County Correctional Facility in lieu of $100,000 monetary bail, and scheduled to have a preliminary hearing Jan. 11 before District Judge Casimir T. Kosciolek of Lansford.
