Slip/fall suit
Barbara and Jeffrey Leibensperger, 4387 Spruce St., Whitehall, filed a civil action seeking damages against the Palmerton Festival Inc. and the borough of Palmerton, 443 Delaware Ave., Palmerton.
The suit states on Sept. 11, 2021, the plaintiffs attended the Palmerton Festival in the borough park. The couple attended a musical performance. After the performance was over it was nighttime and the couple were packing up and preparing to leave with the only light provided being from the stage lights.
The stage lights were turned off, which caused the patrons to be plunged into darkness with street lamps and some lamps in the park to provide lighting. While trying to leave, Barbara Leibensperger tripped and fell over a stump/and or raised roots above the grass surface, which she could not see due to the lack of lighting.
She sustained injuries detailed in the suit. Negligence is alleged against the defendants and sought are damages in excess of arbitration limits set for the county.
Judgment entered
Jonestown Bank & Trust Company, Box 717, Jonestown, filed a judgment for $11,121.32 plus interest, costs and fees against Austin B. Sterner, 706 Church St., Palmerton.
Auto loan default
Westlake Services, 4751 Wilshire Blvd., Los Angeles, California, filed a civil action against Correy D. Espi, 283 Avenue B, Palmerton, alleging he defaulted on an automobile loan. Sought is $15,400.77 plus interest, costs and fees.
Loan default
Accelerated Inventory Management LLC, 1800 Second St., Sarasota, Florida, filed an action against Daniel Vogel, 694 Route 903, Jim Thorpe, alleging he defaulted on a loan. Sought is $6,650.65 plus interest, costs and fees.
Fall suit
Lori Malick, 717 Little Gap Road, Palmerton, filed a civil action against Sharkey’s Billiards and Lounge, Lorah Holdings LLC, and Nicholas Lorah, 2815 Little Gap Road, Palmerton.
The suit states that on Nov. 28, 2020, the plaintiff was a business invitee at Sharkey’s Billiards and Lounge, owned by Lorah Holdings and Nicholas Lorah, when she was caused to fall in a hole in the floor at the defendants’ property, causing injuries detailed in the suit.
Negligence is alleged against the defendants and sought are damage in excess of $50,000.
