Schuylkill County court

Schuylkill County President Judge Jacqueline L. Russell on Monday ruled on the following cases:

Michael James Kinsey, 30, of Summit Hill, was charged by Rush Twp Police Officer Nicholas E. Gallese with theft of leased property and receiving stolen property on Oct. 17, 2020.

He pleaded guilty to theft of leased property, and Russell sentenced him to the 13 days he’s served to 12 months in jail, followed by 12 months on probation. The time is to be served at the same time as a sentence imposed in Bucks County.

He was also ordered to pay court costs and fees; submit a DNA sample and pay the $250 cost.

The receiving charge was dropped.

In a separate case, Kinsey was charged by Tamaqua Police Officer Aaron E. Koehler with making repairs to or selling an offensive weapon, possession of a controlled substance, and use/possession of drug paraphernalia on July 12, 2021.

On June 20, he pleaded guilty to the prohibited offensive weapons charge and was sentenced to serve six to 18 months in jail; pay court costs and fees; submit a DNA sample and pay the $250 cost.

On the drug charge, he was sentenced to 12 months on probation and to obtain a drug and alcohol evaluation and comply with any recommended treatment.

The paraphernalia charge was dropped.

Kenneth W. Vanhorn, 43, of Tamaqua, was charged by Mahanoy City Police Officer Charles F. Kovalewski with flight to avoid apprehension/trial/punishment and use/possession of drug paraphernalia on Nov. 10, 2020.

On Jan. 6, 2021, he pleaded guilty and was sentenced to serve five to 11 months in jail on the flight charge, and 12 months on probation on the drug charge.

Russell granted the prosecution’s request to withdraw its motion to revoke Vanhorn’s probation.

In July 2020, Vanhorn was arrested by Mahanoy City police and charged with attacking his girlfriend with a machete. The girlfriend sustained minor injuries.

He was charged with aggravated assault, terroristic threats, simple assault, possessing instruments of crime, prohibited offensive weapons, disorderly conduct and criminal mischief.

Frank Joseph Ditchey, 58, of Tamaqua, was charged by borough Police Officer Andrew J. Seip with driving under the influence of a controlled substance, first offense on May 7, 2021.

He pleaded guilty, and Russell sentenced him to pay a $1,000 fine, surrender his license for 12 months; serve 30 days to six months in jail; pay court costs and fees; enter and successfully complete an inpatient substance abuse treatment program; and complete Alcohol Highway Safety School.
