A man was sentenced to 3 to 8 years in state prison for heroin, methamphetamine and other offenses Wednesday.
Schuylkill County Court of Common Pleas Judge Charles Miller sentenced Joseph Gibas, 52, with a last known address of New Philadelphia, to the time. Gibas pleaded guilty to manufacture, delivery or possession with intent to manufacture or deliver, driving under the influence controlled substance, intent to possess a controlled substance, and driving while BAC 0.02 or greater while license suspended.
The following charges were withdrawn: marijuana-small possession personal use, use or possession drug paraphernalia, operating a vehicle without valid inspection, and display plate card in improper vehicle.
Miller sentenced Gibas but noted a shorter sentence for a minimum of 27 months is possible because he was RRRI eligible. He was also granted 137 days for time in prison. Fines and costs were assessed.
Miller said the “good news” is that Gibas is alive and has a chance to improve his life.
“You do have a lot to live for especially if you do have a child,” he said.
State Police at Frackville charged Gibas for a Jan. 27, 2021, incident after they initiated a traffic stop in St. Clair after seeing him make a left-hand turn onto Route 61 South from Terry Rich Boulevard after noticing an expired inspection sticker.
Heroin, methamphetamine, marijuana, a digital scale, hypodermic needles and $3,516 were found in the car.
