Credit defaults

The following actions were filed by credit card companies, or their collection agencies, for alleged defaults on credit card/loan accounts.

Citibank, Plantation, Florida, filed an action against James Kirk, 221 W. Abbott St., Lansford, seeking $1,845.13.

American Express National Bank, Bensalem, filed an action against Jennifer Wainwright, 22 Shadblue Lane, Jim Thorpe, seeking $9,755.92.

Portfolio Recovery Associates, Mechanicsburg, filed an action against Gina Porvaznik, 1810 Deer Lane, Lehighton, seeking $1,847.84.

Capital One Bank, Glen Allen, Virginia, filed an action against Barry L. Zetzer II, 266 Avenue A, Palmerton, seeking $4,333.13.

Mortgage foreclosures

The following actions were filed as mortgage foreclosures for alleged defaults on loans.

AmeriHome Mortgage Company, c/o 425 Phillips Blvd., Ewing, New Jersey, filed an action against Stephen Mesaros, 151 S. River St., Plains; Amber Fritz, 1855 Meadow Run Road, Bear Creek Township; and Jeremy Toma, 28 W. Pettebone St., Kingston, all as known surviving heir of Stephen C. Mesaros, over property at 9 Cold Spring Drive, Jim Thorpe. Sought is $146,900.50 and continuing interest.

Legacy Mortgage Asset Trust, c/o 3217 S. Decker Lake Drive, Salt Lake City, Utah, filed an action against Julia and Jennifer Cooper, 56 Jefferson St., Weatherly, over property at that address. Sought is $86,915.60 and continuing interest.

Confession of judgment

First Northern Bank, c/o 4th Street and Lafayette Avenue, Palmerton, filed a confession of judgment action against Jasmine Homes, LLC, Box 850, Blakeslee; and Shatrughan K. and Puneet Sinha, 22 Deppners Road, Blakeslee, alleging they defaulted on a loan. Sought is $517,783.59 plus interest, costs and fees.

Auto crash suit

Kaitlyn Graver, 1116 Main Road, Lehighton, filed a civil action seeking damages against Jack Kemmerle, 122 Maple Alley, Lehighton, over an automobile crash.

The suit states on Sept. 6, 2019, the defendant was operating a Saturn Ion at or near Fredrick’s Grove, with the plaintiff in the front right passenger seat.

Due to the defendant’s “careless, negligent and reckless driving,” the suit alleges, his vehicle struck a tree, causing severe and permanent injuries to the plaintiff.

Sought are unspecified damages “for pain and suffering.”

Suit over product

Kevin and Debra Sterling, 3200 Long Run Road, Lehighton, has filed a civil action against Monsanto Company, 800 N. Lindbergh Blvd., St. Louis, Missouri; Bayer AG, 100 Bayer Blvd., Whippany, New Jersey; and The Service Team Inc., dba Country Junction World’s Largest General Store, 6565 Interchange Road, Lehighton.

The suit states the action was filed by the plaintiffs, husband and wife, as a result of “Kevin Sterling developing chronic lymphocytic leukemia, which were a direct and proximate result of Defendants’ negligent, reckless, willful and otherwise wrongful conduct” in connection with the “development, manufacture, testing, packaging, promoting, marketing, distribution, and/or sale of the products as Roundup.”

The suit alleges that plaintiff Kevin Sterling developed his medical condition as a result of a direct and proximate exposure to Roundup. During the period of 1992 to 2020, the plaintiff used and sprayed Roundup at his residence at least weekly for four months out of the year, without using any protective clothing, the suit further states.

During the period the plaintiff did not know being exposed to Roundup was injurious to his health or health of others, the suit alleges.

Monsanto is named defendant as manufacturing and distributing Roundup in Pennsylvania; Bayer was named defendant, because it acquired Monsanto is June of 2018, and continued to distribute Roundup in Pennsylvania; The Service Team was named defendant for selling the product, Roundup, to the plaintiff.

Sought are damages in excess of the arbitration limits set in Carbon County plus interest, costs and fees.
