Ashfield man given prison term for resisting arrest
An Ashfield man was sentenced to a Carbon County prison term on Tuesday on a resisting arrest charge to which he previously pleaded guilty.
Todd Greene, 47, was sentenced by President Judge Roger N. Nanovic II to serve six to one day less 24 months in prison on the charge. On a summary offense of unlawful activities he was fined $25 and costs.
He was arrested on the resisting count on March 18, 2020, by state police at Lehighton along East Lizard Creek Road in East Penn Township. Troopers responded to an unwanted person. On scene troopers learned there was a warrant for Greene’s arrest. They attempted to take him into custody and a struggle ensued. It took at least three troopers to take Greene into custody and a stun gun had to be used.
Greene had applied for placement in the Restrictive Conditions of Probation program (house arrest) but that was denied by the court on recommendation of the adult probation office.
Nanovic noted Greene had a prior criminal record including operating a drug laboratory and had served time in the Lancaster County prison. He also served three months in Lancaster for violating the conditions of his release.
Greene told the court, “I’m sorry for my behavior.” Nanovic said Greene escaped more serious charges in the East Penn incident because he had a gun and drugs in the vehicle. Police were not able to file charges due to a recent state supreme court ruling.
He pleaded with the court to let him serve the time on consecutive weekends, but that was also denied by Nanovic.
In addition to the prison term Nanovic ordered Greene to get a drug and alcohol evaluation, imposed zero tolerance for drug or alcohol use, not possess any firearms, supply a DNA sample, pay court costs of about $1,000 and pay a $50 per month supervision fee while on parole.
He was given credit for seven days already served and will begin the jail term on Aug. 31 at 11 p.m. He was granted work-release privileges.
