An Allentown man entered guilty pleas in two pending criminal cases on Tuesday in Carbon County court, both occurring at the county prison in Nesquehoning.
Julian Javier Santiago, 30, pleaded to one count each of simple assault and persistent disorderly conduct.
He was arrested by Nesquehoning police at June 17, 2019, for his part in an assault incident at the jail involving two other inmates. Santiago was accused of taking part on the assault of another inmate in a bathroom area. In the case a felony 2 assault by a prisoner charge was dropped in a plea bargain with the district attorney’s office.
The second case occurred on Aug. 20, 2019, at the jail when police responded for an altercation at the jail. Santiago was incarcerated in the restricted area of the prison and was only allowed out of his cell one hour a day. He was found outside his cell at a time he was not allowed. In the case a felony 3 escape charge was dropped in a plea bargain with the district attorney’s office.
It was indicated that at the time of the two incidents Santiago was in the prison facing other charges and spent about two years in jail on those counts, eventually being released after the commonwealth withdrew the criminal complaint against him.
On the assault count Serfass sentenced Santiago to time-served (277 days) to 23 months and on the conduct count, one year probation, with the terms running consecutively.
He was also ordered to make restitution of his share of damages done at the prison in the amount of $257.55, render a total of 150 hours of community service, pay court costs of about $1,000, pay a $50 per month supervision fee while on parole and probation and have no contact with the victim in the assault case.
