Man flees police, found in creek wearing just underwear

A Lehighton man who was found in his underwear partially submerged in a creek was charged with attempting to elude police officers.

According to the affidavit of probable cause filed by Cpl. Shawn Noonan of the Pennsylvania State Police, Lehighton barracks in the case against Jeff Levan:

At 4:45 p.m. March 9, Noonan was on patrol when he saw a black motorcycle at the intersection of State Road and Route 248.

The motorcycle failed to come to a complete stop at the stop sign and turned right onto 248. The motorcycle then accelerated to about 80 mph.

Noonan activated his vehicle’s emergency lights and sirens on Route 248 at Union Hill Road.

The registration on the motorcycle came back to Levan, 51.

Levan made a right turn onto Union Hill Road, and accelerated onto Fairview Street.

Cars coming in the other direction and residents had to get out of the way.

Levan then continued on Fairview Street and passed a car in the opposite lane, going at least 70 mph in a 25 mph zone.

Levan went around a turn and went off the road, onto grass and gravel of a business that displays sheds for sale.

He then continued onto a dirt road before eventually abandoning the motorcycle behind Blue Mountain Machine, Franklin Township.

The area was extremely hilly terrain with Pohopoco Creek separating the abandoned motorcycle and Dam Road.

Police found him in the creek.

Noonan spoke with Levan as he was being attended to by medical professionals because of injuries suffered from running from police.

Noonan also observed the odor of marijuana about his clothing, and he had other outward signs of drug consumption.

He was taken to Lehighton Hospital for treatment.

He refused to consent to a blood draw.

Noonan prepared a search warrant and affidavit for a blood test. Results are outstanding.

A records check of his license indicated that he is currently suspended for a DUI related offense. He also has a previous DUI conviction for 2015.

Levan faces charges of fleeing or attempting to elude officer; driver’s license suspended/revoked; and DUI - controlled substance - impaired ability; recklessly endangering another person; duties at stop sign; driving at safe speed; fail to keep right; careless driving; and operating vehicle without valid inspection.

He is currently incarcerated in the Carbon County Correctional Facility in lieu of $50,000 unsecured bail, and scheduled to have a preliminary hearing March 24 before District Judge William Kissner of Palmerton.
