A Carbon County prison inmate faces two counts of simple assault and one count of resisting arrest after a reported altercation with the prison’s work release director on June 18.
According to an affidavit of probable cause filed by Nesquehoning Police Chief Sean Smith, the assault occurred when Joshua Lee Gundry, 30, of Hazleton, was ordered back to his cell to be locked down.
Work Release Director Frank Shubeck told police Gundry became irate and aggressive toward himself and other officers on max block.
According to Shubeck, Gundry was injured before being committed to jail and ripped his soft cast off his right arm in a fit of rage.
Gundry also screamed and cursed at the officers and said they would have to forcibly move him to his cell, Smith wrote in the affidavit.
Shubeck said Gundry had to be pepper sprayed two times and was handcuffed and escorted to his cell. Shubeck told police Gundry punched him in the left shoulder.
Gundry denied any wrong doing and said Shubeck was the aggressor throughout the incident. Smith checked security video, which corroborated Shubeck’s statement.
A preliminary hearing in front of Magisterial District Judge Casimir Kosciolek is scheduled for Aug. 7 at 1:45 p.m.
