Carbon County Court - Guilty pleas
A Carbon County man pleaded guilty on Monday in the county court to a drug dealing charge.
He was one of six defendants in pending drug-related cases to enter a guilty plea before President Judge Roger N. Nanovic II.
Summit Hill incident
Devon Michael Herman, 21, of Lansford, pleaded to one count of possession with intent to delivery a controlled substance - marijuana. In exchange for the plea charges of possession of a controlled substance and possession of drug paraphernalia were dropped.
He was arrested on April 2, 2017, when Summit Hill police responded to the Lansford Court housing development for a complaint. On scene officers smelled the odor of marijuana coming from an apartment. A consent search was conducted and 142 grams of marijuana was found, along with other drug-related items including bongs to smoke marijuana. Herman admitted to police that the drugs belonged to him.
Nanovic asked why he was involved in such drug activity. He answered that he was “young and stupid.” He said he had sustained a back injury and started to use marijuana for pain relief.
Nanovic placed him on probation for two years and ordered he get a drug and alcohol evaluation and follow any recommendation for treatment and supply a DNA sample.
Other pleas
Ethan Isaih Hunsberger
, 28, of Whitehall, pleaded to one count of delivery of a controlled substance - methamphetamine.
He was arrested by agents of the state Attorney General’s office, members of the county drug task force and Jim Thorpe police as part of a controlled drug buy. Hunsberger sold drugs to a confidential informant on Aug. 23, 2018.
He was originally charged with 24 counts. The police report indicates other sales were made Sept. 5, 2018.
Sentencing was deferred as Nanovic ordered the adult probation office to prepare a presentence investigation report.
Brooke Lee Heine,
31, of Tamaqua, pleaded to one count of possession of a controlled substance - fentanyl.
She was arrested on March 15 by Lehighton police after they served a warrant on her along East Bridge Street. While being taken into custody fentanyl was found.
She is currently an inmate in the county prison on a probation violation petition filed by the adult probation office.
She told Nanovic she went to the Salvation Army program but was discharged from it before completing it.
Nanovic sentenced to time-served 60 days, to 18 months in jail and ordered her to get a drug and alcohol evaluation and imposed zero tolerance for drug and alcohol use.
She told Nanovic she is facing another four months in prison on the probation violation.
Samantha Nadine Heberling,
32, of Citrus Springs, Florida, pleaded to one count of possession of a controlled substance - heroin. She was arrested on July 11, 2018, by Lehighton police at the Lehighton hospital. She was a patient in the Behavior Health Unit when she had a friend bring her heroin to the facility. Hospital personnel found a bag of heroin in her room.
Since her arrest she had gone through a inpatient rehabilitation program in Florida and continues counseling. She told Nanovic by going to Florida she got away from the bad influences in her life.
Nanovic placed her on probation for a year and ordered she get both drug and alcohol and mental health evaluations.
Joshua Yorgey
, 38, of Wilkes-Barre, pleaded to one count of possession of a controlled substance - heroin.
He was arrested on Nov. 12, 2017, by Jim Thorpe police following a vehicle stop along South Lehigh Street. He was a passenger in the vehicle.
Sentencing was deferred.
Aaron Vaclavik
, 35, of Ocean Side, California, and formerly of Nesquehoning, pleaded to one count of possession of drug paraphernalia with a charge of possession of a controlled substance dropped in a plea agreement.
He was arrested on July 24, 2017, when Nesquehoning police responded to a residence along East Centre Street for a reported domestic dispute involving a son and his mother.
On scene officers found various paraphernalia on Vaclavik and in his bedroom.
Nanovic imposed a fine of $1,500 and ordered a drug and alcohol evaluation.
Michele L. Amon,
43, of Nesquehoning, pleaded to one count of possession of a small amount of marijuana. She was arrested on April 1 by Nesquehoning police when they responded to her residence along Stock Street for a domestic involving her and her boyfriend. She also pleaded to a summary offense of harassment.
Nanovic imposed fines totaling $400.
Each defendant sentenced must also pay court costs of about $1,000 and a $50 per month supervision fee while on probation or parole.
