Man pleads to assault count with more serious charge dropped

A Lansford man, originally charged with rape of a unconscious victim, a felony, entered a guilty plea in Carbon County court on Monday to a misdemeanor charge of simple assault, which was added to the criminal complaint in a deal with the district attorney’s office.

David Joseph Robinson, 30, was arrested by Lansford police on Aug. 25, 2018, after a female came to the police station and reported she had been raped. She said she awoke and found her pants and panties pulled down.

According to an affidavit or probable cause filed by police, Robinson wanted to have sex with the victim but she refused, so while she was asleep, he sexually assaulted her.

The report said he admitted through text messages to the victim that he was trying to have sex with her, but she wouldn’t wake up.

He was also charged with indecent assault, a misdemeanor count, which was also dropped in the plea bargain.

Judge Joseph J. Matika, who accepted the plea, placed Robinson on probation for a year and ordered he render 50 hours of community service and have no contact with the victim.
