Nine defendants, who previously pleaded guilty to driving under the influence and related charges, were sentenced on Thursday morning in Carbon County court.

Judge Steven R. Serfass imposed sentences on the following:

Struck pedestrian

Janet Nichols

, 54, of Lehighton, was sentenced to serve 90 days to 60 months in prison, a fine of $1,500 and one-year license suspension. On a charge of simple assault, she was sentenced to serve three to one day less 24 months in prison, concurrent with the DUI charge.

She was arrested on Dec. 28, 2017, by Lehighton police in the area of the Carbon Mini Mart at South First and Iron streets.

She struck a pedestrian while backing out of a parking space. In a plea bargain a charge of aggravated assault by vehicle while DUI was dropped by the district attorney’s office.

She told the court she has spent time in an inpatient rehabilitation program addressing an addiction problem.

“I do take responsibility for what I did. I’m very sorry for what I did,” she told Serfass.

Serfass also ordered her to make restitution of $71, render a total of 200 hours of community service when paroled and zero tolerance for drug or alcohol use.

She will begin the jail term at 9 a.m. on Monday and serve it straight. Serfass rejected a request for a weekend sentence.

Year terms

Jarret Walter Berger

, 20, of Slatington, was sentenced to serve 12 to 60 months in prison, pay a fine of $2,500 and his license was suspended for 18 months.

He was arrested on Nov. 4, 2017, by Franklin Township police along Route 248. A test revealed the presence of a controlled substance.

Berger is currently serving a one- to two-year prison term in Lehigh County for another DUI.

Serfass also ordered him to render 100 hours of community service when paroled. The term runs concurrent with Lehigh County.

Joshua Matthew Burd

, 34, of Bath, Northampton County, was sentenced to serve 12 to 60 months in prison, pay a fine of $2,500 and license suspended for 18 months. On a charge of driving under suspension, DUI related, he was sentenced to serve 30 to 90 days, but must serve the full 90 days, concurrent with the DUI charge, and pay a fine of $500.

He was arrested on July 28, 2017, along First Street by Lehighton police. A test revealed the presence of a controlled substance. He also pleaded to driving under the influence, DUI related.

He was given credit for 143 days already served.

Other cases

Scott A. Russell

, 43, of Lehighton, was sentenced to serve five days to six months in jail, a fine of $500 and one-year license suspension.

He was arrested on Oct. 29, 2017, by Lehighton police along Route 209. A test revealed a 0.09 BAC.

He was also ordered to render 25 hours of community service.

He will begin the jail term at 10 a.m. on Aug. 10 and serve three days and Aug. 17 at 10 a.m. and serve two days.

Michelle Lorraine Conti

, 37, of Albrightsville, was sentenced to serve 72 hours to six months in jail, a fine of $1,000 and one-year license suspension.

She was arrested on Sept. 7, 2017, along Route 534 in Penn Forest Township. She refused a test.

She was also ordered to render 25 hours of community service. She will begin the jail term at 9 a.m. on Aug. 6.

Teresa E. Hubbard

, 41, of Jim Thorpe, was sentenced to serve five days to six months in jail, a fine of $500 and one-year license suspension.

She was arrested on Jan. 26 by state police at Fern Ridge along Wild Creek Drive in Penn Forest Township. A test revealed a 0.26 BAC.

She was also ordered to render 25 hours of community service. She began the jail term immediately.

Adam M. Semmel

, 31, of Lehighton, was sentenced to serve five days to six months in jail, a fine of $500 and one-year license suspension.

He was arrested on Feb. 19, 2017, along Second Street in Lehighton by state police at Lehighton. He refused a test.

He was also ordered to render 25 hours of community service. He will begin the jail term at 9 a.m. on Aug. 17 and serve three days and Aug. 24 and serve two days.

Donald Minnich

, 55, of Lehighton, was placed in the county’s Intermediate Punishment Program for 60 months with the first 90 days on electronic monitoring. Serfass granted the request of the entire term in the IPP due to serious health problems for the defendant, which were documented by medical records.

He was arrested on Sept. 16, 2017, along Route 443 in Mahoning Township by state police at Lehighton. A test revealed the presence of a controlled substance.

Matthew Kromer

, 35, an inmate at the state correctional institution at Mahanoy, Schuylkill County, was sentenced to serve 72 hours to six months in jail, a fine of $1,000 and one-year license suspension. On a charge of driving under suspension, DUI related, he was sentenced to serve one to six months in jail and a fine of $1,000. The term is concurrent with the DUI charge.

He was arrested on Nov. 28, 2017, along Mahoning Street by Lehighton police. A test revealed the presence of a controlled substance.

He must also render 25 hours of community service when paroled. The term runs concurrent with a state parole violation he is serving.

Each defendant must also pay court costs of about $1,000, a $50 per month supervision fee while on parole and follow any recommendation of their drug and alcohol evaluation.
