A Lehighton man who faced vehicular homicide charges for the death of two people in 2014 received a state prison term today in Carbon County court.
Richard Failla, 51, of Oak Inlet Drive, was sentenced to 36 to 96 months in state prison by Judge Steven Serfass.
Failla, on Aug. 31, 2014, was involved in a rollover crash on Forest Street near Sawmill Drive in Franklin Township.
The crash claimed the lives of Brian McGovern and Christopher Mattera.
Failla told Franklin Township police that he was not the driver of the vehicle, but officers later discovered that he was when the vehicle’s key fob fell out of his pocket as EMS were treating him.
The Jeep he was driving left the roadway, impacting a large rock, then trees, before it came to rest on its roof.
Accident reconstruction by Pennsylvania State Police determined that Failla was driving the Jeep at the time of the incident.
The Jeep was traveling 72 miles per hour about 5 seconds before the crash in a 35 mph zone, according to police.
At the time the Jeep left the roadway, it was traveling 52 miles per hour.
