Carbon County court — DUI
Six defendants who previously pleaded guilty to driving under the influence charges were sentenced on Friday in Carbon County court.
Judge Joseph J. Matika imposed sentences on the following:
Monica Anne Marie Matula
, 36, of Brockton, Schuylkill County, was sentenced to serve 10 days to six months in prison, pay a fine of $300, license suspended for one year, zero tolerance for drug and alcohol use and render 25 hours of community service.
She was arrested on Oct. 8, 2014, by Lansford police along Patterson Street. She was convicted following a bench trial before Matika.
She told the court she previously served a year in jail on another DUI charge but has since gone through drug rehabilitation programs.
She will begin the jail term at 5 p.m. on March 9 and serve it on consecutive weekends.
Stephanie Ann Barron
, 36, of Nesquehoning, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, license suspended for a year and render 25 hours of community service.
She was arrested on July 2, 2014, along Route 54 by Nesquehoning police. A test revealed the presence of a controlled substance. She was previously placed in the Accelerated Rehabilitation Disposition probation program but was revoked from it for violating conditions.
She was given credit for eight days spent in jail on the charge and paroled.
Alycia M. Hertzke
, 20, of Slatington, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, one-year license suspension and render 25 hours of community service. On a charge of possession of drug paraphernalia, she was placed on probation for six months, concurrent with the DUI charge. She was arrested on Sept. 4, 2014, along Blakeslee Boulevard Drive East by Mahoning Township police. A test showed the presence of a controlled substance.
She will begin the jail term at 10 a.m. March 24.
Trevor Holtz
, 29, of Freeland, was sentenced to serve 10 days to 24 months in prison, a fine of $500, license suspended for a year, zero tolerance for drug or alcohol use and render 75 hours of community service.
On a charge of driving under suspension — DUI related, he was sentenced to serve 45 to 90 days in jail, but must serve the full 90 days, and pay a fine of $1,000. The jail terms run concurrent.
He was arrested on Aug. 27, 2017, by Weatherly police along Main Street. A test revealed a 0.29 BAC.
He was given credit for five days spent in jail on the charges. He began serving the remaining 85 days on March 5 at 9 a.m. and will serve it in consecutive three-days increments.
James Muffley Jr.
, 34, of Weatherly, was sentenced to serve 72 hours to six months in jail, a fine of $1,000, license suspended for a year and render 25 hours of community service. On a charge of possession of drug paraphernalia, he was placed on probation for six months, concurrent with the DUI charge.
He was arrested on March 1, 2017, by Weatherly police along Plane Street. A test revealed the presence of a controlled substance.
He was given credit for four days spent in jail on the charge and paroled.
Joshua J. Murphy
, 33, of Hampton, Virginia, was placed on probation for six months and ordered to pay a fine of $300 and render 25 hours of community service.
He was arrested on Sept. 10, 2016, along South Lake Drive in Kidder Township by state police at Fern Ridge after being involved in a crash. He refused a test.
Each defendant must also pay court costs of about $1,000 and a $50 per month supervision fee while on parole or probation.
